I am a US citizen currently in the process of bringing my British husband here to the States. The I-130 has been approved and we are now working on submitting the Visa Application (form DS-230) and the Affidavits of Support. My income is pretty close to the poverty line so my father has volunteered to file as joint sponsor. We are having trouble deciphering which forms exactly to submit: the I-864, I-864ez, and/or the I-864a. I was under the impression I file the I-864 and my father files the I-864a. Is this correct? Also, what tax information shld we be submitting? Just the return itself(I can't remember the form number, sorry..) or also the W-2's, pay stubs, something else? And my final question, my father has a position waiting for my husband at his business when my husband arrives. Should we include information about this? If so, what do you recommend?

Thank you for any and all help.

Your father would only file I-864a if he lives with you. Otherwise he needs to use I-864. He should submit tax transcripts or copies his returns including all W2's for the past 3 years as well as a letter from his employer and pay stubs for the past few months. He also needs proof of citizenship.

Hubby working without EAD (employment authorization) or a green card is against the law. So telling the interviewing officer that he intends to break the law would not be a wise move. Edited to strike out bad info by me. Time to put away the caffeine.

The I-864 instructions are very informative. I encourage you to read them along with these two links from the Dept. of State website: I-864 FAQ Preparing Affidavit of Support forms

As he would be coming in on a CR-1 he would be entering as a permanent resident and therefore it would be perfectly acceptable and legal to start working right away.
