after my case sent back we try to send to uscis and dos and here the answer from dos , we need frindes here to explain espaicley when they say : act 222(f) of the ina usc !!!

From what I read the consulate found something that would make inadmissible.

You will have to wait for USCIS to send you a Notice Of Intent To Revoke and see what they say, and then may have to provide evidence to refute the consulate's findings.

yep for some reason it can take a long time for a NOIR to happen after a denied visa interview.

In K-1 cases one of three things will happen.

• USCIS feels the consulate is unfounded in denial, they will reaffirm petition and send back for another interview, sending you a letter they did this.
• USCIS decided to administratively close the petition, considers it expired, they send letter stating to try another petition either get married or try another K-1
• USCIS sees the inadmissibility and revokes the petition, this is the BAD one, you need to address the revocation with evidence, I would get a good lawyer involved with this. Perhaps someone like Marc Ellis

DoS is pretty much saying it is out of thier hands and in USCIS's hands at this point... can take months or more to get the letter from USCIS stating how they will handle it.. one of two things will happen.. a letter saying that your petition has expired and that you are free to apply again.. or a letter stating that you have a specific period of time to rebut the findings of the consulate. He should have been provided a document by the consulate stating the general grounds for denial... be prepared to rebut if the opportunity exists.. if not, then when you apply again you will need to address the issue in the petition else they will provide a NOID and provide a timeframe to rebut that... at this point it is a waiting game .. waiting to see what USCIS does.. check with them routinly to see what the status is of the case...

The section of the code they cited just meant that they cant discuss the procedure involved in deciding a case or the process details... it didnt mean anything when it comes to the denial itself.. just about the inquiry for information..

i got a letter last night said that they find out that the case is expired and now they gonna close the case without prejudice and we are free to file again if we want to with the right fee and support document !!!!
