My wife arrived in the US late April 2010 with a K-3 VISA valid for three years I believe...I will have to confirm the exact date of expiration with her---but I believe it is sometime in March of 2013.

I deployed to Afghanistan in October 2010, and prior to that I was involved in a lengthy training exercise, which took up a lot of our time and made it difficult for us to focus on anything else.

I return to the US in October 2011. Will this grant us enough time for the AOS procedure, or should we start now?

Thanks,

Mark

More than enough, I believe. :)

I am engaged to a military man as well, and he is set to deploy when you get back, also leaving me with the same prob. I hope we finish AOS before he leaves!

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png

Spouses of deployed military can attend the interview by themselves. I believe they would need your signature on documents, but other than that they can do it by themselves when you are deployed. If you are here now you could file the paperwork and she could take it from there. If you want to wait until you are back, AOS is taking about 3-4 months right now. Once you apply and get a notice that it has been accepted for review, your wife will enter a new period of authorized stay, and the date on her K-3 will not matter (unless she plans to travel which is another lengthy explanation :)). There is also a military helpline for more specific information. Good luck and be safe.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

K3 visa is good for 2 years upon entry to the U.S. You will have plenty of time for her to file for AOS, however, you have to note that the longer you put it off, the longer your wife will be unable to work (she needs an EAD) or do much else.
