Hi everyone,

I just completed N400 application but have a question regarding "permanent residency" on this form. It asks: Day you became permanent resident?

I came here on a K1 Visa. First I had a 2 yr conditional residency and later I received a ten year green card. On my green card it says: Resident since 02/07/2006 and Card expired: 01/11/2018.

My question is: am I a permanent resident since 02/07/2006???? I received my first conditional residency on this date, that's why I am confused. What date did you use?

Yes you became a permanent resdent Feb 7 2006.

A conditional permanent resident is a permanent resident, residency begins when you are approved for a green-card, be it conditional or not.

Hi everyone,

I just went through the N400 process, I'm getting sworn in on 1-14-11, I used the date on my second card, which would be 02/07/2006 for you and everything was fine.

Ok lets put it that way. if you received ur 10 years green card, in 2009 then for sure you are not eligibal to apply for ur Citizenship. first .. so to be eligibal then u are resident since 02/07/2006 .

in other words, you resident on the day you received ur 2 Years Card.

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

Thank you to all of you for quick and simple explanation. I put "resident since" date on this application. I will send this package out on January 12th. Since I do not have tax return of 2010 yet (no W2 or any other paperwork) is it acceptable to send 09-08-07 returns? I think that the immigration officer would be able to understand the reasoning behind it. What is your advice? Thanks. Lia.

That is fine, you are not expected to file your return in January, however if your were filing after April 15, then a 2010 return may be expected.

A: That's a valid question. Thank you for bringing it up. To determine on whether or not the information on your Green Card is correct or incorrect, I would need to know your birth date, the amount of siblings you have, whether or not you smoke and/or sleep walk, and what your lucky number is. We also would need to know if the I.O. who adjudicated your AOS case is a relative of yours or had been convicted of fraud. Oh, and most importantly, I would need a donation of $25 to my PayPal account NeverBelieveNothing@aol.com.

Once my wife and daughter received their NOA for our AOS, they were here legally, but with minor exceptions, could not get a drivers's license, could not go to school, nor work, but yes, they were here legally. We no longer had concerns about their I-94 expiring, but they could not travel.

At the advice of my great immigration attorney, sent in an additional, think it was around 600 bucks for an EAD card, my I-130 said for a wife, action was immediate, guess that the USCIS defines immediate as seven months when the EAD cards finally came in. At that point, my child could go to school, wife could work, and we could apply for a probationary SS card. But that was NOT the date where they considered lawful permanent residents.

It wasn't until another six months went by when we finally had our interview, I was allowed to attend and was told they would get a "conditional" lawful permanent resident card. That is sure a contradiction in words. Even though they were here legally for approximately 13 months, they were only considered conditional lawful permanent residents at the date on their so called yellow green cards.

A further mix up by the USCIS misplacing her completely separate application from her moms' resulted in her green card coming in two months later. But fortunately for us, that was within the 90 day difference in dates permitted in the I-751, see others were longer than 90 days, so the sponsoring US citizen had to apply separately for each child that meant even more money. It was neither these parents fault nor our fault the USCIS screwed up, but you still have to pay the price.

Just wonder if that long delay was intentional so my stepdaughter could not tailgate her mom with US citizenship, if it wasn't for such long delays in USCIS processing, she would have been well under 18 when my wife could apply, but again its that date since you became a lawful permanent resident that only counts. I tried my best to point out the reason for these dates WAS their fault, did you ever try to get into a discussion or an argument with a wall? So my stepdaughter had to wait another two years, we already put 450 miles on the odometer with another 900 miles to go with more days off of work, we did not pass go, but had to pay another $675.00, man are we lucky, see it's $680.00 now.

Well, in brief, forget about all those other dates, only the date you became a LPR counts, even if you had long delays in getting that date. They could have predated my stepdaughters green card since they "misplaced" her application, but used the date they found it instead.

Should clarify about my stepdaughter, her status here was nebulous during the AOS stage, and the DOS is unclear about this. But did check into it with a group of attorneys and she was legally able to attend school according to some Texas supreme court law. But the DOS never really clarified the status of a person here under the AOS. But wife definitely could not work nor get a drivers' license until she received that EAD card.

But have to say, until my stepdaughter received her EAD card, that was a period of stress. Think USCIS stands for United States Congress Induced Stress.

In the late 60's and early 70's were really the dark ages of this one great country when hundreds of new governmental agencies were form, and working in industry, learned many conflicts and contradictions between these agencies making their own laws. Really didn't give a damned, just showed them to the back door of my plant and told them to go out and fight it out between themselves and agree to what they wanted me to do. But between the DOS and the USCIS, this was with my family so really felt the stress.

All this discussion about socialism, communism, or a democracy is pure BS, the key word is dictatorship, and with some odd 1,525 different agencies to deal with, we live under a dictatorship. Name one senator, congressman, or even the president that can name all these agencies let alone what powers they have. Then the last idiot congress and president create yet another agency, Homeland Security that is suppose to cure all these problems we as individuals are faced with on a daily basis. The heads of these agencies are those that helped these guys get elected with no other type of knowledge, doubt if anyone of them can even pass the US citizenship civics test.

Anyway, that is what we have to learn how to deal with.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Well BOBby that is a perfectly valid question. The question is about PERMANENT residency and that is why it can be confusing. I understand that you are a very clever person but some of us do get confused by these little details.
