Hi my fiance thinks that with his income will be enough for the I-134 form.

Right now his income is $24000 a year+ a bonus of $6000, ! But he owns no house,no property,and since he haven't had stable jobs for the last 3 years he hasn't been paying taxes.

He just got a good job (the one where he is making 24000+6000)in june 2010 and now he is paying taxes,

He also have 3 kids, he says that their kids will not account on the I-134 because he hasn't claimed them on his taxes since he pays child support for them.

So I dont understand :wacko: . To me even if he pays child support they are dependent of him, but he says they are not, since he hasn't claimed them in his taxes.

SO in the question 8 of the I-134(The following persons dependent upon me for support) should he name his kids or not?

The thing is that after all of this,I still think we need someone else as a sponsor, I read that there is not such a thing as a CO-SPONSOR in the K-1 visa.

we have a friend of my fiance who qualifies to be my sponsor but we don't want to use her at least it is necessary.

So what should i do? do i go to the interview with 2 I-134 forms(one filled out by my fiance and the other by his friend) and show them the I-134 one filled out by my fiance and if he doesn't meet all the requirements to be my sponsor, show them the I-134 filled out by his friend.

Or should I show them both I-134(filled by my fiance and his friend) and in the interview they will decide wich of them qualifie to be my sponsor.

Or before going to the interview I already have to chose who of they 2 will be my sponsor???

I really would like to get a lot of answers so i can show my fiance.

His income is $30,000 per year. He has a family size of FIVE. Him, 3 kids and you. The children most certainly DO count.

Your fiancee is required to file income tax, he does not need to have a "steady income" just AN income. He MUST file his taxes for the past three years or he will not be able to file for your AOS. he will need at LEAST one years taxes filed for the visa interview. He can file taxes by googling 1040/2009 and 1040/2008 and download the forms, fill them out and file the taxes. If he owes money he should pay it now or arrange a payment plan. If no money is owed, there is no penalty for filing late.

If he represents himself as having a family size of TWO (you and him) and it is discovered otherwise, that would be a material falsification and your visa could be denied and you could be barred from any future visas. It sounds as though your fiancee is either unfamiliar with tax law or is simply in denial or being deceitful. That will not help. DO NOT lie and DO NOT falsify anything in this process. The children COUNT until they are AGE 21 oe until they are age 18 and living on their own. Who claims them on taxes is a TAX ISSUE, not an immigration issue.

$30,000 is NOT enough to qualify for a family of five.

1. Get a co-sponsor lined up, document his income

2. file delinquent taxes (and pay as needed)he will need to file at least for 2010, 2009, 2008

3. DO NOT lie or falsify.

If you get a co-sponsor then that person must qualify to sponsor YOU, himself and any children/dependents that he has and yes, must submit an I-134 and all documentation so you would present TWO I-134s at the interview.

If his income was too low to require filing, he should so state that but it must be the truth and he must find out if it's the truth. Either way, I doubt he'll owe much if anything in the way of taxes.

i have a question about the topic.Ive been working for the same company for the last 5 years but sometimes i work full time and sometimes i work whatever hours they give me so the last 3 years i didnt make enough to sponsor my fiance but i have a cosponsor my question is does it matter how much im making right now and the in the past does it matter how many hours im working right now?and how much im making? if i have a cosponsor.

If you have a qualified co-sponsor your present income is not an issue.

Probably doesn't matter unless the visa is to be issued in Manila or Bangkok. Is it?

HE DIDN'T PAY TAXES IN THE LAST YEARS BECAUSE HIS INCOME WAS TOO LOW,

HE HAS JUST STARTED WORKING FOR THIS COMPANY IN JUNE 2010, AND HE IS PAYING HIS TAXES NOW.

HOPEFULLY, IF MY INTERVIEW IS IN JUNE OF THIS YEAR OR AFTER, IT WILL BE ONE YEAR OF HIM WORKING THERE. I KNOW THAT HIS INCOME IS NOT ENOUGH FOR 5 PEOPLE BUT I WANT TO SHOW THE EMBASSY THAT HE AT LEAST IS WORKING AND PAYING TAXES NOW =)
