Hi everyone,

I am an American perpetual tourist living in Costa Rica for 5 years. I have left only a few times for a just a few days each time to stay legal with Tico immigration. Me and my fiance have lived together here in Costa Rica for 4 of those years here and now want to go to the US.

My question is simple. I have read on the Costa Rica US embassy website that I am supposed to have Costa Rican residency to do DCF but have also seen exceptions on this website.

Question.

If we get married, can we do direct consular filing?

I want to add that she is Nicaraguan but has Costa Rican permanent residency.

Thanks

Probably not, as you are not officially/ legally resident in Costa Rica (what is your residence on your US tax returns?), but you should contact the US embassy and ask them.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi There,

You need to have a Cedula to File DCF in Costa Rica. Me and my husband went in the US embassy last month and brought all our papers trying to filed DCF but they won't accept it. In order to file DCF in Costa Rica you need to be a resident or at least you start working your residency papers for more than 6 months. We live in Costa Rica for 2 years, I have my temporary resident through working permit and my husband is a perpetual tourist too.
