Can Additional Info. be put in Packet 3

Greetings Everyone,

The NVC just sent our petition to HCMC approximately 3 weeks ago and we expect (hopefully) Packet 3 quite soon. I have a question. My fiance' has filled out most of the necessary forms and we have most of the documentation prepared. However, can we include the timeline, photos, and/or any other evidence (eg. emails, chats, etc.) in packet 3, or is that something you bring to the interview.

Secondly, we will hold an engagement ceremony February 6th, 2011 (we filed the petition July 2010) because that was the time we believed most appropriate. Our attorney is saying not to date the engagement ceremony, but we are VERY uncomfortable with lying about the date, as we believe we can explain we are having this ceremony late (my divorce was not final until June 2010). Please keep in mind that we have seen each other 12 times (5 times in VN, 5 times in Thailand, 1 time in Europe) and have approximatly 7,000 pages of correspondence and many photos. I see that some people who get pink had not even had the ceremony. Others had it before filing the I-129F, while others held it either right before or after the interview. I guess my question is: should we not date the engagement pictures or should we?

moving to VN regional as the HCMC specific response may be the best response here...

A few others have done just what you are thinking... It can work both for or against you depending on the CO... They may wonder why did this guy send the extra info.. is there something hes trying to overcompensate for?

It is your packet, you can put anything you want in it. This does not mean they will look at it, my friend has tole me numerous times they are not obligated to look at anything they do not deem necessary, or anything they have not requested. I thought that was bull because if we feel it is important then they should have to look at it, but they dont (they are god...er the devil I mean :devil: )

ON a similar subject, when at the interview and when they request additional evidence... I asked him why is it that when they ask for some information such as in my case and many others why did they refuse to look at it when the benificiary had it with them. He stated because they gave a notice requesting it, and I said again that she had it at the interview already, and his reply was if they do not have EVERYTHING they ask for then they do not have to accept any of it because it is not all there. They are over worked, and to spend extra time looking at some things but not everything they wanted has been deemed a waste of time since all the required evidence is not there in theory they would still not be able to make a decision and they are to move to the next application once they feel no decision can be made at that time.

Basically we can do what we want when it comes to what evidences we submit, but they are still the ones making the decision, and if we submit something that they feel is not important they are not obligated to look at it, and they will have the final say on what to or not to look at.

When I was preparing my documents, my fiance was asking me the same thing about putting more documents in Packet 3. I never felt comfortable with it and we ultimately decided not to do it. In the end we got a pink slip so I don't know what difference it would have made. Personally, I think you should not do it but that is just my opinion. Best of luck

Adding additional evidence to the packet 3 response could potentially give them additional ammunition to deny the visa without the protections you would have if the evidence had been included when the petition was sent to USCIS. Any evidence you submit is a double-edged sword. It can help make your case, or it can provide evidence of a red flag. If it reveals a red flag then it's far better if it's included with the petition. It makes it much more difficult for the consulate to claim that USCIS didn't know about the red flag when the petition was approved.

Once the petition has been submitted I wouldn't send any more evidence, other than the required forms, unless they specifically ask for it.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

In fact, my fiance' just got a letter from the HCMC Consulate today asking only for forms DS2001 and DS230 Part 1, which we can simply email to them. They specifically mentioned (in the attached link they sent) NOT to send additional information. As our petition only left NVC 3 weeks ago, things seem to be moving quickly. In the letter it says she'll have her interview in 1-3 months time.

I have a question: there has been no request for the other forms that we thought were required, such as the DS156 and 156K.

Is this process that we are seeing in our case the same as your cases.

They specifically mentioned (in the attached link they sent) NOT to send additional information. As our petition only left NVC 3 weeks ago, things seem to be moving quickly. In the letter it says she'll have her interview in 1-3 months time.

She'll be asked for those forms in packet 4. She brings them to the interview.
