Timeline

Hello All,

:help: What do you reccomend in the case, when:

K-1 is expired on 01/01/06;

we do have NOA-1 about AOS;

we do have NOA-1 about EAD;

we do have 6 points;

we do have Marriage Certificate;

but our local NJ DMV has refused application for the driver's permit :no: , justifying their decision that we do not have legal status ( paper) in the country. It is kind of odd that my wife cannot drive until AOS is final in one year or so. :unsure:

09/02/2005 - NVC has processed the case

09/07/2005 - NVC has sent the package out.

09/08/2005 - NVC paper letter received.

09/12/2005 - Kiev embassy confirmes- case is received!

09/13/2005 - requested interview date on Sep, 23 by email

09/13/2005 - interview scheduled on Sep, 27

09/27/2005 - Interview day! Approved!

10/2/2005 - Arrival to JFK

10/16/2005 - SSN application

10/23/2005 - SSN received

12/07/2005 - Wedding

12/28/2005 - sent AOS package

01/05/2006 - AOS filed

01/09/2006 - NOA recevied

You need the EAD, because this is the one obtainable document from "list one" on the lists of documents needed to apply for a driver's license. But...there is an alternative:

Here in MN, you can apply for a State ID with: A passport, and a marriage certificate. With a State ID and a Social Security number, you can then apply for the Driver's license. I see your spouse DOES have a SS number. I'd give that a whirl.

In most states, a State ID card is obtainable even by temporary visitors to the US - I've had a couple of friends get one simply to avoid taking their passports everywhere! Sensible! Try it, and see :) Then with ID and SS number in hand, the permit should be forthcoming - I did that on Friday :)(F)

3/3/08 - Check cashed for ROC at CSC...

Feb 2009 - Called USCIS to see what the heck was goin' on...

FEB 20th 2009 - Received email - GC on the way!

I am APPROVED for the 10 year PR Card!

Here in California, you need your EAD, your State ID and your SSN. I had to show them these 3 documents. Good Luck!

01/25/2007 My daughter's Interview in Sacramento, CA APPROVED!!!

02/10/2007 Today is my daughter's birthday and today SHE GOT HER GREEN CARD

REMOVING CONDITIONS (I-751)

07/15/2008 I-751 sent (daughter included as dependent child)

07/21/2008 I-751 received (Laguna Niguel-California Center)

07/23/2008 Only one check cashed ($545)

07/26/2008 I 797-NOA Extension Letter received (only for me)

07/28/2008 Check $80 (daughter's) returned

08/04/2008 Infopass!

08/14/2008 Biometrics appointment 8:00 am (just me)

10/16/2008 2pm Interview in Sacramento. APPROVED!

11/06/2008 GOT MY GREENCARD, Expires 10/30/2018

10/23/2008 I-751 sent for daughter, check for $545 included

10/27/2008 I-751 received (Laguna Niguel-California Center)

10/30/2008 check cashed

11/06/2008 My daughter got her I-797-NOA Letter of Extension

08/01/2009 My daughter got her GREENCARD, 10 years

There are no State ID in NJ( :no: ). There is only NJ DMV ID card and in order to get you need a primary document. It looks like this loophole does not exist in NJ. :devil:

Same process here in Indianapolis. I showed my EAD, my SSN, our marriage cert, and our latest joint bank account statement (as proof of residency) to apply for both a state ID and the learner's permit. And if the second part of this process is the same in other states, you will need to wait a little longer to obtain the learner's permit and state ID card. The license branch told us that my documents would have to be verified at a central office before they can issue the cards. So I'm carrying around a legal-sized piece of paper that acts as my temporary learner's permit.

They're kinda wishy-washy in NJ at the DMV. They do require the EAD or a US birth certificate, regardless if you aleady have the 6 points. I took marriage certificate, EAD, SSN, my overseas drivers license and proof of residency. Because I already had driving experience, the driving test was waived. Had to do the vision and knowledge test (80% pass rate of 50 questions). So I was issued a license valid for about 15 months with a big red TEMPORARY IMMIGRANT STATUS on it. That was my experience. But try again after EAD or Permanent Resident Card has been issued - no problem mon :D .

We have never seen EAD card before. Is there an Expiration Date on it?

If Yes, will NJ DMV consider EAD as a key provement of the legal status? :blink:

My EAD will expire next Sept. one year after they gave it to me. But I have to reapply for it 3 months before the date of expiration in order to renew it. I don't know if I have to do this every year, I'm not in that point yet.
