ok - there was some embassy in India where his K-1 visa was approved -

write them, the IV unit - tell them that you two are divorced and that he is re-married.

also write USCIS in USA, tell them the same thing.

eventually, when he tries to return to USA, he'll be stopped at the border, not allowed in,

as his immigration status is based on marriage to you. They will gather his green card as well (if he has it on him) and send him out of USA.

since he abandoned the marriage, got divorced, and remarried, left the country -

his immigration status CAN end IF you do these things.

It's a bit different than 'most' occurences, as he's already outside of the USA, divorced from you and married to some one else - so YOU have some things to do, if you'd like to keep him OUT of the USA.

If you know the name of the mosque where the divorce was finalized, a copy of the divorce document resides there, and you can write to the Iman/Muallah there, ask for a copy to be sent to you (include some USD currency when you write him, as well) .

When you get this document, have it translated into English - then send off copies of both to the entities I mentioned above. Don't wait, though, to inform them of the current situation, though - send the divorce documents later.

eh - HE's divorced from HER, though -

and she can take that divorce document from the Mosque, have it registered with the Indian Authorities ,

and then be legally divorced WORLDWIDE.

It really is that simple - but the hard bit will be to find out WHICH Mosque handled the 'divorce document', IMO.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You need to find out if that divorce is legal for you. If it's not (and I doubt it is legal for you) then you will still need to file for divorce. You have that voicemail which I agree with Bob4Anna that you should not delete the voicemail, it's good evidence of his fraud. Call ICE and ask them what you should do. I would personally also send a letter to USCIS letting them know that you've been abandoned and that he's religiously divorced you in India and that you are filing for divorce.

One of the conditions of his 2 year card is his marriage to you. Usually when people get divorced on a 2 year card they should file to ROC asap to avoid issues.

I am so sorry that this is happening to you. Please take care of yourself and your growing baby. Do what you need to to protect yourselves.

**Edit - what Darnell said is the best advice re getting the religions divorce recognised for you. I don't know how you're going to find out where he got the divorce done though so maybe just filing a divorce in absentia in your state is the best option.

No he has religiously divorced me. Since we got married here I got to get my legal divorce here. We have been married only for 6 months now. Got married end of July.

Thank you that is a good start. I was in touch with the IV unit quite a bit prior to his K-1 being approved. I have taped the voice message already.

You have that voicemail which I agree with Bob4Anna that you should not delete the voicemail, it's good evidence of his fraud.

i'd also suggest the op make that copy fairly soon, as my voicemail tends to delete itself after it's a month old.

Hi OP. Did your caller ID or phone records show that he was actually calling from India? I think he has already proven to be untrustworthy. Just wondering if he is trying to hide the fact that he might have stayed in the US. The way he left seemed awfully odd. Your original post said he didn't use credit cards or his cell phone after leaving. Did he already have cash for the plane tickets?

Thank you for all your help. I am trying to figure things out and try to put my life back together. I just want to know what is the number to call to report a case just like mine. I have so many things to do so I can move on and this is just one step.
