In any case, when Border Patrol agents catch you don't try to run, as they are going to shoot at you. Get detained and they'll drop you off at the Mexican border again without hurting you.

Can you provide a little more info on your situation?

- Where are you crossing?

- Why are you crossing?

- What is your citizenship?

- Do you have a visa for the USA?

Give a little more info about your background and the purpose of your trip and someone might be able to offer you some advice here....

Sorry everyone, I'm new to this. I'm Canadian and I'm planning to cross over to the US. I plan to fly over and visit my husband for 3 weeks and then come back. He booked a ticket to come back at the end of January so I would come back with him.

Is your husband Canadian or American (or something else)? Does he live in the US full-time and if so, what is his status?

My husband is American living in the states. I applied for the I-130 already.

As long as you can prove you still live in Canada I THINK you should be okay. My cousin (a Canadian) was in a similar situation and she would often visit her husband in the USA for extended periods of time. Her car was still registered in Canada, she had a home in Canada and was still a Canadian resident. And of course, your return ticket should help to show you intend to return to Canada.

Now, all that being said, I'm not sure how exactly your pending I-130 (and I assume pending I-485) would play into this. I know when my applications were pending, I would not have been allowed back into the USA, had I decided to leave before getting my AP. Since you are already outside the USA, you are in a slightly different situation.

Since you have already filed, that really does change things. Let's see what the other folks in VJ have to say....

I take it you are doing the i-130(cr-1 visa). You may have some problems but you probably wont. Bring any "proof of ties to Canada"... letter of from employer stating that they expect you back at such time, lease,any bills in your name, return ticket, do you have any children who reside in Canada, if so add that to your list of ties, etc. Make sure to bring any immigration paperwork such as noa-1 or noa-2.

Just have a back up in the case that they do not let you through, :)

2-18-2011 - Day 11[/font]- received NOA 1 in mail for I-130, I-485, I-765, I-131

2-22-2011 -Day 15- received biometrics letter -appt March 14

3-10-2011- still cannot see case online although I called USCIS two days ago

3-14-2011- Day 35- Biometrics done on the appointment day

3-24-2011-Day 45-case showing up online!!!! USCIS mailed on 3-23 my interview appt letter- April 26 is the day!

I second what others say - have lots of proof of your ties back in Canada. You probably won't have any hassle but keep in mind that you could also have a border guard who decides that he/she is not in a good mood that day. Sorry - don't want to be negative - just a heads up.
