Hi

Me and my husband will be starting the process soon and i think i have this all straight in my head.

I'm the USC and my husband is Canadian. We both currently live in Canada and I have PR status in Canada. We both want to move to the US as i want to be near my family and what not. I know we can file DCF however I do not have domicile in the US and no US income so we are thinking this may not work for us. Right now we are think I should go back to the US by myself, get a job and file CR1 from there. I will have to live with my parents and they would be my co-sponser with no problems. We have been married 3 1/2 years with no children.

Does anyone have any suggestions or comments on going either DCF or CR1? We just want to be together in the US with the least amount of problems from the immigration side....if that is possible Can't believe we are thinking about immigration again after the fun of Canadian immigration only 3 years ago

I have herd that filling DCF can reduce months off your waiting time. we started going with the CR1 and a lawyer friend of ours said we were crazy! with DCF the wait is betweem 2-3 months for everything, while if you fill in the US you can wait up to 8 months! so we actually started with a CR1 and have now changed everything to be going the DCF route. it seems to be better, and may cause less time apart. also for info while your CR1 and DCF are pending they recommend that your spouse doesnt enter the US, or you can risk the whole file been blocked, so keep that in mind cause i havent seen my husband in 2 months and its no fun. :(

Hope that this helps and good luck!

Can I ask, when you re-applied with the DCF did you have to cancel the CR-1? Did the lawyer do this for you, I am just wondering.....how you cancelled the CR-1 (if you did)

If you are able to file I-130 in Canada instead of the Service Center, the wait time to visa will be closer to 5-6 months. If you file in the US, the wait will be much closer to one year.

Yes we had to cancell our CR-1 by sending them a letter saying that it was faster with the embassy, and since you were there on vacation you decided to take that direction.

Good luck =)

I'm confused.... how do you file the I-130 in Canada? Doesn't it have to start with the Service centre nearest the spouse living in the US? Or is this only an option when the US spouse is living in Canada too......?And what is a DCF?

new at this!

Yep... our DCF process, from I-130 filing to interview date, will be six months to the day. Montreal is now telling people to expect 6-8 months from start to finish.

April 28, 2001 - Married in my hometown, South Bend, IN

May 2, 2001 - Crossed Canadian border and finalized my landed immigrant status

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
February 2006 - The process of bringing my Canadian family to the States begins, so that my two beautiful children can learn about their whole heritage.
March 8, 2006 - I-130 approved in Calgary
March 21, 2006 - Received approval letter and Packet 3
April 17, 2006 - Sent Packet 3 back to Montreal
April 20, 2006 - Packet 3 received by Montreal
I think the timeline can vary a lot. Mine was actually pretty quick so far. I went to Montreal on July 5th, 2006 and submitted my I-130. About a month later I got notification that my final interview was set for September 29th, 2006. That's a little over 3 months from start to finish.
