I'm not sure what to do right now. I'm so furious I could scream.

After an initial rejection for the wrong fee, my husband and I prepared and sent off his AOS from an L1 a second time. The forms expired on Dec. 31st and we prepared the AOS on the 29th and mailed it the following day to the Chicago lockbox via certified mail with delivery confirmation.

On Jan 3, we recieved a delivery confirmation from USPS that the application packet had been delivered. Today I received a package from USPS marked "Found Loose in Mail". Lo and behold, there was the AOS application, rifled through and out of order and held together with a rubber band.

How on earth can they provide me with a delivery confirmation when it wasn't delivered? To add to that, the idea of some random someone digging through our financial records and personal information infuriates me. Even worse, what if some part of our application arrived independently of the rest? That would result in rejection number TWO. Would we even have another chance?

I just went to re-download and print our I-485. I've calmed down somewhat. The USCIS website is still using the form that expired on 12/31/10. Should I just wait until they update their website with a new form? Because I have other stuff that can expire in the meantime.

You will likely be waiting a long time for them to update the form, I would send it asap.

Also make a complaint to USPS too! That is horrible service.

I agree. Fill out the form and mail it in ASAP. The USCIS and US embassies and consulates use expired forms a lot. If this is what is on their site, use it DON"T wait.

And do file a complaint with the USPS. You can also call the local head office too, and speak with the local postmaster about the terrible service. He/she may investigate much faster for you.

Thanks :) I re-organized our application and it looks like nothing is missing. My husband really made me see the bright side here by pointing out that our checks were still there and so was the very pricey medical exam. He's en route now to the closest Fed Ex to mail it again. I just don't trust USPS to get it there in one piece anymore – if they get it there at all.

I did call USPS and was told that as long as the envelope itself arrives at its destination, whether or not the contents of the envelope are still present is irrelevant. Imagine that. I do have to give the girl I talked to credit, she felt really bad about what happened to us and wasn't rude like I anticipated. She said I could send it USPS Express, but the same thing applies – as long as the container arrives, they consider it delivered. Fed Ex might not be safer, but I really don't feel like entrusting this to USPS again.

Hopefully we won't end up with some weird strike against us for them receiving an empty manila envelope with our names on it. lol
