NO, they do not have to prove she didn't intend to immigrate because she won't be attempting to immigrate. She's going back to Sweden to wait out the spouse visa process.

11/19/10: CRBA package couriered to US Embassy in Manila

11/22/10: CRBA package/application including NSO BC & MC received by embassy

11/22/10: NOA1 Date

11/24/10: Electronic notification of receipt received from Chicago Lockbox

11/24/10: Embassy scheduled CRBA appointment for 12/21/2010

11/26/20: Check cashed

11/27/10: NOA1 Hardcopy received via USPS

12/21/10: Interview/Personal appearance at Manila Embassy for CRBA **approved**

I would strongly advice a visit to sweden after you get your citizenship before you start filing. This would boost your application from the word GO at USCIS instead of during the application

It's Sweden, a low fraud country as it pertains to US immigration. There is NO NEED to delay filing a petition once married.

I would strongly advice a visit to sweden after you get your citizenship before you start filing. This would boost your application from the word GO at USCIS instead of during the application

She will be here in March or April, this is when we plan to marry. Are you suggesting a trip to Sweden prior to her arrival here in March or April or after that?

I don't quite understand how this will boost the application, please elaborate.....Thank you.

Time spent together is the strongest evidence of a bona fide relationship. The advice you're asking about came from a member coming from or bringing a loved one from highest fraud Consulate in the world, relative to US Immigration. Sweden would be on the opposite end of the fraud spectrum, so visit as you desire. No need to plan extra trips just for evidence. You'll be filing shortly after her trip here and your marriage. Silly to wait, in my opinion.

The advice you're asking about came from a member coming from or bringing a loved one from highest fraud Consulate in the world, relative to US Immigration. Sweden would be on the opposite end of the fraud spectrum, so visit as you desire. No need to plan extra trips just for evidence. You'll be filing shortly after her trip here and your marriage. Silly to wait, in my opinion.

I hope this does not throw a "Monkey Wrench" into our plans, so let me ask you this.......

She was born in Tehran Iran and is still a passport holding citizen.

She has resided in Sweden for the last 21 years and is a passport holding citizen of Sweden as well.

Will the multi citizenship cause any problems or delays in the Visa process or do they only look at the country she is immigrating from?

Maybe. It's hard to say. You'll be indicating the place of birth and her place of residence and citizenship and it will be what it will be.

Ask in any immigration forum here or in the applicable regional forum. The short answer is the poorer the country, the higher the instance of fraud. The Swedes, British, French etc. are not highly motivated to attempt to enter the US fraudulently. They have access to Western living standards and opportunity where they are.

Timeline

Intent to marry during a visit is NOT an issue. Intent to enter, marry AND immigrate (stay) based on that marriage is the issue. The issue has a name, "Visa Fraud". Your plan is just fine.

If we were to get married in Sweden rather than in the USA would it prove to be more difficult to bring her to the USA on a CR-1 / IR-1 Visa?
