Affects of not using approved K-1 visa

Hi, I am May. I live in the Phils. I got approval for K1 one month ago and got my visa. Our relationship went bad and my U.S. fiancee changed after that. I no longer wish to marry him. I am still in my country. How do I tell the embassy? If I wish to marry in the future, will the fact that I already had K1 stop me from getting it again or make it too hard? Also, would there be a time limit like 1 or 2 years before I could be succesful at getting another K1?

The 1-2 year thing has to do with US citizen filing I-129F, not beneficiary receiving one.

You can simply let the K-1 expire, or contact Embassy about turning in the immigrations packet un-opened.

In the future, the Interviewing officer may have questions about your prior K-1 visa, they may question motives about why the two attempts at getting to the USA and your motives, so stronger documentation may be needed for a second visa petition by a different person.

hi sorry to hear that. i think better off to report it so next time when you have another petition you can come up clean on their records. also it might be better if you try to attach an explanation of the reason why the intent of getting married failed.

I would report it to them and surrender the documents. You would not be breaking any laws by sitting back and letting it expire, but it would be better to turn them in, thereby generating a record of your doing so.

Should another American propose to you, make certain to tell him about this unfortunate episode up front. This way, he can tell them in his I129f petition that he was satisfied from day 1 that you made an honest mistake and were not looking for some sort of green card sham or other fraud.

I know this is not the case, but you would think they would understand that there is no sham or fraud as i will chose not to use the visa. I guess logic is only a small factor.

Hie maymayann, my story isn't exactly the same as yours, but I'd like to chime in and say that it'd be good thing to write them a letter and tell them that you are not using the visa. Submitting the documents, like the other posters have said, is also a great idea. My ex-fiance and I had received our NOA2, but a few weeks after that our relationship ended. I had received Packet 3 but since I wasn't going through with the relationship or the process, I wrote the US Embassy in Malaysia about not wanting to continue with the process. That's all I had to do to end it.

All the best, and I'm sorry for the end of your relationship. Breakups always suck.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.
