Hi

Me and my husband will be starting the process soon and i think i have this all straight in my head.

I'm the USC and my husband is Canadian. We both currently live in Canada and I have PR status in Canada. We both want to move to the US as i want to be near my family and what not. I know we can file DCF however I do not have domicile in the US and no US income so we are thinking this may not work for us. Right now we are think I should go back to the US by myself, get a job and file CR1 from there. I will have to live with my parents and they would be my co-sponser with no problems. We have been married 3 1/2 years with no children.

Does anyone have any suggestions or comments on going either DCF or CR1? We just want to be together in the US with the least amount of problems from the immigration side....if that is possible :) Can't believe we are thinking about immigration again after the fun of Canadian immigration only 3 years ago :)

03/22/2007 Got e-mail from Montreal that interview is May 22nd!

05/15/2007 Finally received interview letter

05/22/2007 Approved!!!!

05/28/2007 Visa arrived!!!

05/31/2007 Big move to the US

06/12/2007 SSN arrived

06/22/2007 Welcome letter arrived

06/28/2007 10 year Green Card arrived!!!

05/31/2010 Eligible to apply for citizenship

You should post another Q on the DCF board and ask the Canadians who have done it how much they had to show for domicile. You could use your parents as a joint sponsor for that route. OR you can also apply through Vermont while staying up here if you didn't want to move and be apart from your husband. Someone on the Canada board just got approval doing this. Could you use your parents address as a perm address in the app? I really would suggest poking around on the DCF board and find out how strict Montreal is in the interview regarding the domicile. Filing a CR1 from US will mean quite a long time without your hubby.... or lots of travel!

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

11-06 - Interview Montreal (success!)

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-22-06 Interview / Visa approved

Yes i can use my parents address as a perm address because we will live with them when we get there just until we can find a place to live.

I would like to stay until we can move together just don't know if we can :)

See HumanUnit's post as far as the reference I made to someone applying CR1 while in Canada through Vermont. Start a post "proving domicile for Canada app" and see if you can get response to what they had to show. I know BCEd's wife hadn't lived in U.S. for 5 years and they just got approved. They had to get a joint sponsor though, so that is key. (Since few people doing it this route would have U.S. jobs already in place). I would think getting a headhunter before interview, showing you've been sending resumes and getting responses might help too. There's definitely people who have successfully applied while staying with hubby/wife in canada so good luck to you.
