We are going to get marry next week then she will apply for my immigration.

Perhaps you can 'let her drive' by showing her the guides here at VJ ? That'd be a great thing, especially since she's the USCitizen and needs to know exactly how to do it, and what to do.

When you file I-130 and fill out the FORM I-130 you cant NO LONGER SELECT

K-3 VISA.

So no matter how you file it will end up and CR-1/ You have the check mark

the box at the top of the I-130 Petetion. Soyou cant select or mark K-3

ANY LONGER. IT HAS TO BE A CR-1 I-130.

so TRY FILLING A K-3 AND WILL Probably be sent back to you to refile

and be declind as a K-3.

Feb 2010 K-3 were phased out and were terminated. IF you want you can take

a chance an waste time and have it take longer to do.

But take WARNING THERE NO FILING A K-3 with a I-129 any more

you will delay your process and your I-129 will terminate and stop once

your I-130 approved and be chaged into a CR-1

Try it but dont be surprised if you find yourself waiting a long time

to be approved.

??? I-130 NEVER had a check-box or any way to specify K-3, the procedure was and still is file I-130, wait for receipt letter indicating which service center is handling the I-130, then mail an I-129F along with copy of the receipt letter.

Again, it is how USCIS and NVC are handling the petitions that has been closing the K-3 option and proceeding on with the spouse CR-1 visa.

Soon we will apply for k3 visa, i talked to USCIS they said by Feb 2nd new immigration policy is going to implement according to that now cases will get process not more then 5 months.

Does anybody know about this new policy rules whats bad or good points ????

Is it easy or making difficult k3 processing in new rules ?

just relax, read through Visa Journey and gather info... you will not only gain info on what to file (and no need to share that with anyone if you do not desire to) but in addition to WHAT you will learn, the biggest most important thing is you will learn WHO to listen to and from who NOT to take info! Obviously the two above need to be put on that list. at the other end, people you can take their word on pretty much eveyrthign they say would be people like Darnell, PatiencePaidOff (otherwise known as Loto), and there are many many many knowledgeable people as well (though i dont know i would take every word as gold like i do these two ;-) LOL but i do hold a lot of people on here in very high esteem and you will too once you get to know who knows their stuff... i'm surprised you dont already since it shows you joined almost 2yrs ago???)

good luck ... and as far as the k-3, my opinion (not that it means anything, that and a $1.90 will buy you a cup of coffee at any coffee shop) is that if we had not filed the k-3 those of us who got transferred to TSC would be waiting even longer becasue seems like they're processing i-129f 's before the i-130's there. but maybe that is just an illusion.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

UH! Just calm down.

The K3 visa has been administratively closed, however this DOESNT stop the USCIS from accepting both the I129F and the I130.

However, generally they are tied together and you will end up following the CR-1 route. If you want to spend the $1000(?) filing fee for the I129F feel free.

There is no definitive answer about this, but it seems generally it will slow your process down and cost you money, when you will end up going for the CR-1 anyway.

However, it is entirely up to you how you proceed, but the general consensus is not to bother with the I129F

Please dont get scared, that isnt going to help ANY step of this process. Air your fears and questions here and we will all try and help you!

If you recall, when you first joined you professed that everybody going through the process should hire a lawyer to avoid any kind of mistake.

As you may now be aware, lawyers are also not immune to making mistakes.

I had a complicated case by many of the members here, standards, yet didnt use a lawyer. If anything lawyers have been known to slow things down. I can think of at least one member, if not two that have been hindered by a lawyers process.

If you're unsure of any info - its best to let some of the more knowledgable members on here contribute to peoples advice, or inform the member asking the question that you arent totally sure.

K3 is still available to apply for, for example. As far as I am aware - one is still able to file an i-129F - where the application automatically turns into a CR1/Ir1 at the NVC stage.

Last my other wife died of cancer.

So I found another wife and doing the process again, so dont think i dont have any

experience, like all you have doing it only the first time around NOW in your life.

to your Senator or Congressman thats what they get paid for.
