Hi- working on the I864. My most recent tax year is 2004 (I haven't filed yet for 2005). In part 3D of the 864 form, they state "Minimum income requirement from the Poverty Guidelines Chart for the year 2004 is _____ for a household size (of 2)."

Where can I find the 2004 requirements? Also, do they want the 125% of the poverty level or 100%???

Please help, we're trying to get these forms done and sent off.

Thanks

If you look under "forms, fees and fingerprints" and under that "forms and fees" in the USCIS webpage, there is a form called poverty guidelines... That will tell you the poverty level... And unless you are military you need 125%.. Its I-864P...

the address for that is:

http://uscis.gov/graphics/formsfee/forms/i-864P.htm

good luck!

Somewhere in the I864 form they say where you can find the powerty guidelines, it's available somewhere on the uscis.gov. When we filled the form we put in the 125% of the powerty level. I think the 100% is for people who are in the army and their income doesn't have to exceed 100% for sponsoring purposes. Also I think if you don't include the 2005 taxes you might get RFE for it later on.

Hi

I'm pretty sure you need to use the 2005 poverty guidelines as the 2006 aren't in effect yet...but definately don't use the 2004 guidelines. I think they relate to how you can actually support your fiance in t he here and now, so you go by the current guidelines.

Plus they're looking for 125%

Good Luck and hope alls going well there :)

Amanda
