Hello all,

I am new here to these forums, and I have to say that the contents of these message boards is an incredible resource!

I do have a couple of questions, but first let me explain my situation. I am the USC and I married my wife in May 2010 in Mexico. Due to some health problems and some very expensive medical bills, I haven't been fortunate enough to have the financial resources to begin the K3 visa process until now. I have been traveling back and forth to Mexico since May to visit my wife and spend about a week or so at a time with her. Well, the last time I went to Mexico, I suffered complications from my diabetes, almost died, and spent a week in the ICU of a Mexican hospital. I was hit very hard financially because my health insurance isn't valid in Mexico.

I would live in Mexico here with my wife while the visa application process runs it's course, however I would be putting my life at risk by doing so, seeing as I don't have the financial resources to pay for more medical bills w/o insurance.

I need to be receiving a new medical treatment in the US in February, so two weeks ago my wife applied for a B-2 non-immigrant visa, and had her interview at the Mexico City Embassy so that she could be with me while I get medical treatment. Well, once they found out that I was a USC they denied her B-2 immediately, no questions asked, wham bam thank you ma'am.

I would go the route of a DCF here with the Embassy, however, I haven't been here for more than 6 months on the current Mexican Visa that I have, and staying here much more time isn't really a viable an option for me.

So I am going to file my I-130 with the intent of getting a K3. If my I-130 gets approved first or if my I-129f gets administratively closed, well so be it, we'll go the CR-1 route.

Ok, so after my schpiel, my questions are:

Can I have the petition/visa application process expedited at both the USCIS and NVC levels? If so, how would I go about doing so?

Would a letter from my congressman work? A letter from a doctor?

The bottom line is, I need my wife to be with me in the US as soon as possible so that she can be with me during my medical treatments. I need your advice! HELP!!!

Here is the link you need for expedites. It is much more than simply asking for one. You'll need documentation to back up your claim and sufficient reason why your wife MUST go to the US to be with you

K-3 is dead, don't even bother with the I-129F. And there is no 'if' your I-129F will be administratively closed...it WILL be administratively closed.

Most definitely do an expedite! Have u submitted the I-130 yet? If u have and already have a receipt notice (NOA1) with your receipt # u can call USCIS and ask for a service request for an expedite due to medical reasons. Start gathering your doctors notes/letter stating your condition and needed treatment. Within 5 days after u submit the service request, u will get an email from the officer working on your case asking u for evidence to support your expedite request. He will give u directions in the email on how to send it to him, usually via fax. Expedite usually takes up to 90 days for them to approve it. I got an approval after one month. Some people get an approval less than one month.

When u get approved with USCIS, your case goes to NVC. Once u get a case # from NVC, give them a call and ask how to request for an expedite. They will give u an email address and they will tell u what to put in the subject line to send an expedite request. Usually they forward your expedite request to the consulate (in your case, Mexico) and they will accept or not accept the expedite. If they do, NVC will forward your case to the consulate and everything that wasn't submitted or done in the NVC stage, u will complete in the consulate. In my case, our case was forwarded to manila (Philippines) consulate. Once they received it I was able to schedule an early interivew. I kept calling and asking if they had it in the system. Once they did I booked an interview date. If u have any questions u can message me. Read around the forums cuz there are great people here that are more than willing to help the "newbies". Hehe

If u look at my timeline u will c our journey has been smooth and speedy.3 months after submitting the petition with USCIS, we were able to get an interview date :) I truly believe prays can do miracles. God is good alllll the time! Good luck!

Pardon my ignorance, but how would I go about reformatting it for an original I-130 Spouse petition without having an existing case number like your example?

Hi. I read that your process took only 3 smooth months. How were you able to get them to expedite it? I want to expedite my petition and I need to know what to do. Any help is greatly appreciated. Thanks so much.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

how or what reasons can u guys expedite all the time?i have depression and panic disorder can i expedite?i see that the diabetes thing might work....but everyone needs and wants it to go pretty fast!save the expedite who really needs it!im confused with this!?

I expedited my case based on US National interest. I hear Medical situation work too.

I told the guys at NVC what I do and why I need expedite. they just say ok. I don't even have to sand them a single document to prove anything. I just told them the truth and they granted the request.

if you have medical satiation . you can apply for expedite but you have to provide them with documentations to prove it. that what I notice from those who request expedite.

You can try only you never know.
