This is true.

Here DOS site explained about Date unchanged:

Please Note: Applicants entitled to immigrant status become documentarily qualified at their own initiative and convenience. By no means has every applicant with a priority date earlier than a prevailing cut-off date been processed for final visa action. On the contrary, visa allotments are made only on the basis of the total applicants reported documentarily qualified each month, compared with the amount of available numbers. For example, during the past month, over 17,300 of the applicants who have become documentarily qualified in the Family preference categories have priority dates earlier than the cut-off dates established for January. Demand for visa numbers can fluctuate from one month to another, with the inevitable impact on cut-off dates.

Following are examples of possible cut-off date actions based on demand:

Numbers

Retrogress Number Available----Demand of Priority date current date----- Next month cut off will be

3000-------------------------------------1000-----------------------------------------------Advance

3000-------------------------------------3000-----------------------------------------------Remain the same

3000-------------------------------------5000-----------------------------------------------Retrogressed

Hi guys,

I follow your quotes whenever I can. I'm in F2A category, and spouse PD is september 2009. I'll apply for citizenship in Sept 2011. Last year i was hopeful that 'my spouse can come to the u.s. sooner than i became a Citizen. but after Jan 2011 bulletin published, we lost hopes.

my case is in NVC (I-864 was received dec.2010). regarding citizenship, i have several questions. As i have heard here from you guys, i can apply 3 months before that date which means june 2011.

How long does it take for me to become citizen from June 2011? Is it possible to have citizenship before sep.2011?

Can i leave the country after submitting the necessary documents immediately?

to be eligible to submit documents for citizenship,I should be living in the u.s. at least 2 and half years. Can this three months (from June to September) be counted toward two and half year rule?

Another question on F2B visa. Right now, it shows Jan 2008, does it mean that no embassy ( i mean NVC

) ( even in european countries that there are a few applicants) will issue visa for someone with PD later than Jan 2008?

thanks for your replies.

Fisrt of All, You can apply your citizenship prior 3 months of your 5 years period of green card.

Secondly, It is not GOOD IDEA to leave the country after submitting documentation for Naturalization. You have to wait till Biometric/Initial Interview/Oath ceremony complete. Also you have to submitting the copy of Citizenship certificate to upgrade your aplication from F2A to IR1.

Thirdly, F2B priority date as shown on Febuiary bulletin is 15APR03!!!:star:

U need about 6 to 8 months to complete naturalization process from the date of eligibility for Citizenship. Means if u r eligible from Sept 2011, then hopefully by April 2012 your naturalization will complete according to my experience.

U can leave country after submiting doc. But as MB said, its not good idea to leave country. In N-400 form , U need to mention what u r doing now. U need to proof that u are a continuous resident and for that u need to submit last 5 years tax docs. Also u can submit letter from your current employer or your rent agreement or mortgage docs. Idea is , u need to proof that u are continuos resident.

U need to be present in US for your biometric, Citizenship Interview and also for Oath. Normally they suggest not to leave country between Interview and Oath. So its better not to leave after submit docs.

First i edited your post so you can clearly see the responses.

1. You can Apply 3 months prior to the date shown on your resident card. USCIS are very particular/strict about the 3 month rule so i would left about a week pass before you do send it in so there would be no rejecting the application.

2. The time it takes to be naturalized varies by location and it is average of 6 months after the Form N-400 is filed.

3. No not possible to be naturalized prior to September 2011 .. thats's 3 months!

4. Yes you can leave the country AS SOON AS you submit your documents there is NOTHING against this! Please know that you will need to be fingerprinted(biometrics) 30-45 days.. as long as you show up! you're free

5. Living in the USA for 2 1/2 years..? If that how long you have been here..? Did you MARRY someone..? IF your answer is yes then you will not be eligible. You must be married to and living with the same US citizen spouse for 3 years. If you did not obtain your status through marriage the ignore that part. Other wise you must have been in the USA for 5 years as a LPR with "continuous residence." ans yes the 3 months will be counted..(June - September !!

6. Yes.

The process will not take up to 8 months. That was 2+ years ago when processes were slower.

U need to mention what u r doing now. U need to proof that u are a continuous resident and for that u need to submit last 5 years tax docs. Also u can submit letter from your current employer or your rent agreement or mortgage docs. Idea is , u need to proof that u are continuos resident.

That is not true you do not need to show proof of ANYTHING EXCEPT that you are a LPR. A letter from any employer, check stub, rents agreement/s , mortgage ( anyone could be living there that's nothing), 3 or 5 years tax documents, nothing! The ONLY time that where the tax document is involved are for those persons filing for their citizenship BASED on the 3-year rule marriage to a US Citizen and that is ONLY as "proof" that you are/were married to & living with the same US Citizen.

U need to be present in US for your biometric, Citizenship Interview and also for Oath. Normally they suggest not to leave country between Interview and Oath. So its better not to leave after submit docs.

They dont suggest anywhere during the application process. Who put a stop in their life for some N-400 process..? Matter fact on the day of of the "OATH" there is a form that you fill out asking if you have traveled, got arrested etc since the interview.. that's only to confirm you are still meeting the "eligibility
."
