Well lucky for you, ur case is already completed so once thngs start moving again you won't have such a long wait. I am still waiting for approval from USCIS hopefully they won't decide to hold my case until the priority date is becoming current again. Its still better than it was before earlier last year the PD were 5yrs behind nw they r 3yrs. Lets try to stay hopeful.

What's your PD?

My PD is 3/2008...Unfortunately Bangladesh waiting list is huge for F2A category...My PD might get current next visa bulletin, but wont get interview date. I have seen many VJER's from Philipines PD 2007, still waiting for interview as their country qoata have reached according to November visa waiting list...

Oh No! We still have to keep hope! i took this from the Report on the IV waiting list from the VO website.

"The four year interval between the cut-off and calendar dates for most countries assures that

many petitioners will be eligible to naturalize before 2A visa numbers become available for their

spouses and children. Upon naturalization of the petitioner, a pending 2A case is converted

automatically into the "Immediate Relative" visa category, which is not subject to numerical

limit and therefore has no visa waiting period. As a result, the amount of cases being processed

in the "Immediate Relative" category is likely to increase, and the rate of new F2A filings would

stabilize the waiting list."

I am agreeing with you ricardo, i remember in 2006 when my husband got his greencard his priority date was ahead of what the bulletin stated. I think the countries with the higher waiting list will be affected more by the retrogrssion.

Ricardo you were asking about the per country limit, I took this from The VO website.

"The thirteen countries with the highest number of waiting list registrants in FY2010 are listed

below; together these represent 78% of the total. This list includes all countries with at least

65,000 persons on the waiting list. The per-country limit in INA 202 sets an annual maximum on

the amount of preference visas which may be issued to applicants from any one country; the

2011 per-country limit will be 25,620."

I think its the grand total issued annually for a single country which includes all the FAMILY BASED F(1234). For eg Mexico cannot exceed 25620 annually while we add all family based.

if so.. that's good.. that would WIPE clean all the approved applications at the NVC/counselor office.

I think thie retrogression, is to discourage more LPRs and individuals who would fall in the preference category from filing petitions.

I know you filed before i did. My priority date is December 30, 2010... but guess what I hope to have an interview say sept. - November 2011

Of course, just hoping they wil continue to approve the petitions within the 5 month time frame, I would be more relieved. I'm just back to my original plan. Hubby can do his naturalization this yr so thing aren't so bad.

That's nice when is he eligible to apply..? Once he apply the process will take approx 4-5 months. Yes I would say USCIS would continue to approve the applications within the 5 months ..

remember he can apply 3 months prior to that would make it june 2011. IF September 2011 is with the 3 months then he's looking to be approved about feb. 2012. If by then you've become current and cause is being processed at the NVC without delays I would leave it as is.... you should know which route would be best by say june 2011 by then you case should be at the NVC and you can see the visa bulletin cut off date.
