My wife filed for my AOS back in August, I have already received my AP and EAD but have not heard from USCIS on my AOS or my wife's I-130 since then. My employer wants me to go aboard for work related assignments and it would be impossible to come back for interview if it happens while I am outside the US. I dont know why its taking long...

I called USCIS several times and mostly spoke to the Second level IO on the phone and like everyone else got different versions of the story: Some said the case takes one year of process, some estimated that I'd get the interview letter by mid-December, a couple said that the name check is done, one said its waiting for NYC local office for interview, a couple said its still with NBC, etc. But no news or RFE on either I-485 or I-130. I have had my wife write to the local congressman and they said they'd follow-up and in the meantime I wanted to make InfoPass appointment to see if my visit can trigger the case to resume. So I called USCIS today and they are saying that despite what it says on the website (4 Months processing) they are still processing July 3rd applications so they cant issue me a Service Request - that is required for an InfoPass. So now I cant go to the Infopass since I dont have SR ticket.

Do I have any other options to make them look into my case? I cant find many cases that get dragged for so long. I am just nervous that they might reject the petition while I am outside the US, preventing me from coming back :help:

P.S: Most of the August and more specifically NYC cases have been resolved

Your interview letter should arrive about 45 days before your interview - will that be enough time for you to get back? You've already got your AP so you are covered there.

Another thing to keep in mind is the length of your time overseas. If you have a GC you are expected to be in the USA for a certain amount of time each year unless you get special permission. I'd hate for you to "move" overseas and have the IO assume you don't live (or want to live) in the USA.

I guess 45 days is enough as I dont plan to travel for long duration ... its just several trips that I dont think I could cancel if I book and interview lands on the same day.

Thats good. Glad to hear that at least its moving - even in a completely random order. When I called last time they told me NYC office is processing June 3rd cases, may be they have moved up a little. I am guessing I'll get a letter in a month. this is insane!

Good luck on the interview, keep us posted on how it went. I have been seeing that lately NYC applicants are not getting their decisions right on the spot and are being told to wait 60 days. Hope they give you on the spot.

Just noticed that they delayed your bio appointments for 5 months, which probably delayed your whole process. Wonder whats the hold-up for me. By the way, which Congressman did you write to?

11/03/2010 - Received at Chicago address Fed Ex delivered - (Day1)

11/08/2010 - Received Text and email confirmation, checks cashed - (Day6)

11/12/2010 - Received Hard Copy NOA's - (Day10)

11/13/2010 - Biometrics appointment scheduled for December 8th - (Day11)

11/17/2010 - Successful Biometrics walk in - (Day14)

06/14/2011 - still nothing, no online update since 11/17/2010. so frustrated (Day lost count)

08/03/2011 - received email that interview is scheduled for 09/08/2011

09/08/2011 - interview Garden City - received first card production ordered email :)

It is backed up but I know that some applicants who applied after or right around when I did, already have received their cards. Its random and backed-up. You might get lucky.

Biometrics was delayed because they were back logged and aside from that their office here in Long Island will be moved to Holtsville from Mineola which is farther away so they were really busy. I wrote the Congresswoman McCarthy, she's the one from my district.

I don't mind waiting for 60 days as long as we're approved. I've stopped looking at people's timelines because it discouraged me when I did not get my biometrics then, this whole visa process can be stressful really if you let it comsume you.

Anyway, am always hoping for the best and the best of luck to everyone as well. I'll keep you posted.
