Hi everyone,

I've started putting all the paperwork for the AOS. I do have a question on something & hope someone could help me on it. My husband would be my main sponsor, am i correct on that?

Right what i want to ask is... My husband doesn't work as he is a full time caregiver to his father. On the paperwork of the I-864 Part 6 Sponsor's income & employment: 22: He is currently unemployed with no income. The only thing he gets is food stamps. His father gives him room & board. What i want to ask is, do i need to put a letter explaining this situation why he is unemployed with no income?

My sister ln-law is sponsoring me as she meets the requirements of the 125% of poverty line.

Any help will be much appreciated & many thanks

We first met online 2004, but things started to get serious in Dec 2007. Made my first visit to the USA in march 2008 for 2 weeks. Then returned again in Aug 2008 for 3 months.. Then i came back to the UK for 5 months to return back to the USA April 2009 for another 3months.

The person who filed the I-129F K-1 petition (SPOUSE) MUST me primary sponsor, sister-in-law can act as a joint sponsor.

So Two I-864s needed one from Husband as Primary, and one from sister in-law marked Joint Sponsor.

Moving this to the correct Adjustment of status Forum.

Is now a US Citizen immigration completed Jan 12, 2012.

Don't mean to be rude that didn't answer the question i asked. I know that i need my husband & sister in-law to fill out the I-864's. My question was does my husband need a letter to explain about his situation why he is unemployed with no income? As he is a full time caregiver to his father...

We first met online 2004, but things started to get serious in Dec 2007. Made my first visit to the USA in march 2008 for 2 weeks. Then returned again in Aug 2008 for 3 months.. Then i came back to the UK for 5 months to return back to the USA April 2009 for another 3months.

No He can simply state "unemployed" checking 22 (d) on his I-864, however will be required to provide past year's IRS return or transcript, or an explanation why one was not filed.

That would be no use to him to provide past year's IRS returns or transcripts as he hasn't worked since 1996. He has been a full time caregiver to his father since 1996. So guess he would need to give an explanation to that one?

He has to produce either a tax return for the most recent year or explain why he didn't have to file. (Reason being, that he didn't earn enough to need to file.)

Other than that, there is no reason to provide extra information.

Other than that, there is no reason to provide extra information.

Well I don't think the IRS would supply my husband a Tax Return dating back to 1996. I was checking out the IRS website & this was what I found stating.. "Both transcripts are generally available for the current and past three years and are provided free of charge. The period in which you will receive the transcript varies from within ten to thirty business days from the time the IRS receives your request for the tax return or tax account transcript".

If anyone else can put some input to this it would be much appreciated.
