Yes, this is the case where a K-2 follows to join.

Also if K-2 is already here, and their I-94 expires they will start accumulating out of status time, if AOS is not applied for.

However keep in mind if K-2's green-card is issued more than 90 days after parent's then removal of conditions for the K-2 WILL cost you extra!

WOW I did not know if I didn't know that bit of info thanks.

Yes they both came into the U.S at the same time.

Their I-94 expired in December, so i want to apply as quickly as possible for the green card this week and in two weeks apply for our son.

I prefer to do it together but she really wants to get work soon.

Would you recommend applying for both together and not take a chance to have the green card issued after 90 days for the K2

I would recommend filing then together in same envelope, just treat everything as if being sent separately, NO sharing of evidence.

Set everything in separate piles I-485, I-765, I-131, then use a clip to keep each separate from other.

Each I-485 needs an I-864 from sponsor. Copy if K-1 I-129F approval notice, G-325A for K-1 visa holder copy of marriage cert, etc..

Apply both together and apply for the free, when filed with the 485, the EAD for her do she can work as soon as possible.

I agree I think I should apply for both together. I wanted to apply for her first since I had the money available and apply for our son a few weeks later. I guess its best to wait and apply for both.

It can take upward of 4 months to get an EAD, all the time the K-1 cannot take a job, it would not be "A few Weeks"

No-one seems to have mentioned this:

Price of AOS for K1: $1070 (and the same for K2 over 14)

Price of AOS for K2 under 14:

* Filing with the I-485 application of at least one parent have a fee total of $635;

* Not filing with the I-485 application of at least one parent have a fee total of $985.

Basically you save $350 by filing your K1 and K2 Aos's at the same time... I wouldn't wait 2 weeks.

If I decide to wait to pay for the K2 visa I would pay a total of 2055.

Is that correct? & why would you decide to wait if its cheaper to pay together?

Some people don't come with their K2's, they follow later (up to a year) so they can't really wait.. well they can but it means the parent can't work for quite a while but for those people the waiting makes sense. if the parent is working and saving/earning then they can make up the difference. If they're in your situation... makes no sense (to me at least)!
