She can do that, yes. Problem is, they leave her waiting.... and waiting... and waiting, and in the mean time she has no idea if they're doing anything, since they've obviously done nothing in six months to help her. I'm trying to give her something to do in the mean time to try and get an answer from someone else. Obviously she's already got an application in at the SSA office, and she's trying to get help through them, but they've failed her three times already. The definition of insanity is to continue repeating the same behavior again and again expecting different results. Welcome to U.S. Immigration.

If I'm remembering correctly how did you finally get the help in getting the SSN assigned?

By going to the local CBP office and having them fix the error that was made at my husband's POE, which is why I'm suggesting it to her.

I thought you sent an e-mail to SSA?

No, I don't have an email address for the SSA. I called the DOS and the USCIS and they both told me Peter was in the US Immigration system correctly, that it had to be a problem in the SAVE database, and to call the CBP. I called their 800#, and they confirmed that it was probably an error on their part at his POE and referred us to the local Deferred Inspection Site. We went there, spoke to an officer who used Peter's I-94 number to find him in the database and fix their error. (He'd been entered as a B2 instead of a K1, even though the POE officer wrote K1 three times on his passport and I-94.)

This is when the officer also did some digging and discovered that Peter's hard copy file had never been sent ANYWHERE, and nobody knew what had happened to it. He said calling Chicago to ask them would result in him being laughed at, since they get thousands of people through there every day, and that we'd have to submit his AOS paperwork and hope they could reconstruct his K1 file on their own from whatever digital copies they had.

We later found out that when the Embassy processed his visa they put his first and middle name in the first name field and his last name in correctly, so it looked like he had a double first name in the computer. However, on paper you wouldn't know the difference. The SSA wouldn't issue the SSN until they were able to get authorization from the DHS to do so because of this error. The DHS fixed it, and he got his SSN.

The database can be accessed and changed by the CBP and DHS. The SSA can only see what's there. If she's not showing up in the database at all, the CBP didn't enter her correctly. This would require her I-94 (yes, I know it's expired) and the help of someone from the CBP to do some digging and find out where she is. They probably won't do anything over the phone for privacy/security reasons. They'll need to see the passport/visa/I-94 in person.

Dodi - thanks for the Detailed Explanation -

IMO/E - SSA can not CHANGE things with SAVE - in real time - but

secondary inspection / deferred inspection with CBP CAN change things in SAVE, in real time.

Stupid SSA people - I'm bringing brownies with exlax if I ever have to set foot in their offices for my wife's stuff.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Thanks everyone, i applied for a SSN nearly two weeks ago and have been chasing it each week, i also contacted our local senator so am waiting to hear from her. I think next week i may just pop to the office that Dodi was talking about. This is now beyond a joke. I do however have my AOS interview on the 21st Jan, does anyone know if i can ask them about the SAVE database or the reason i have not been issued a SSN?

I Quit - i have done some of your suggestions but nothing has helped to date. I appreciate everyone's feedback because maybe, just maybe someone else would have gone through this and could help somewhere.

I have been having the same problem with getting an SSN. I applied for one just over 6weeks ago & still have no SSN card. Knowing that i had plenty of time to apply for one before my I-94 expired. Now my I-94 has expired, so no chance in getting a SSN now. Even though i called the social security office today to find out whats happened.. The woman wasn't helpful at all, all i was told was i had to go to the office in person to find out what's happened..

When you get your EAD get straight back down there and reapply. It is so annoying though as no one seems to be able to help you and when you have stuck to the rules someone else screws up and your left hanging. Id love to be working right now but instead i am chasing a SSN and getting no-where! Good luck with yours

I do however have my AOS interview on the 21st Jan, does anyone know if i can ask them about the SAVE database or the reason i have not been issued a SSN?

You can ask them, but I'm pretty sure that the USCIS works off of a different database than the SAVE. When I went there with Peter when we first discovered the K1/B2 error they told me he was in their database correctly and couldn't find a problem. In fact, they couldn't even look him up by his A-number, they had to go off of my receipt number from our I-129F, and kept trying to tell me they couldn't find him at all till I lost my temper and then suddenly he was in there. Peter felt sorry for the idiot when we left, until after we'd been through this about 10 times with 10 different incompetent gubmint employees, and he finally got as frustrated as I was. But he kept his British cool and let me do the complaining. Apparently I'm better at it than he is. :blush:

Honestly, my best recommendation is the CBP office. They handle immigration walk-ins on Wednesdays (or they did 2 months ago) but if you walk in any other day I doubt they'd just turn you away if you stand your ground.

Well what a day i had at the social security office.. I had applied to get a SSN 7weeks ago & without getting anything in, i decided to go down to the social security office to see what the hell has happened to it. After waiting a very long hour in there, i proceed to give the lady the receipt i got when i applied for the SSN. Dated back to 16th nov. with the reference number. So the lady started punching the info into her computer looking very puzzled. Then she says oh you are in the system. Then she disappears off to speak to the lady who originally dealt with me 7weeks ago. Then the next thing i see was the 2 women were looking through their filing cabinets to find my paperwork. Then i hears the lady that dealt with me originally "i found the paperwork" Then the other lady comes back to me we got your information back just thursday past & you won't be getting your SSN as you're I-94 has now expired. The woman asked me could i get my I-94 renewed & i looked at her & said to her you can't renew a I-94. Well that was it i was in a rage after hearing that. I asked the lady why has it taken you 7weeks to have this processed & you couldn't be bothered to inform me by letter? I'm just wondering if they even bothered to get the paperwork processed. As i made sure i gave plenty of time before my I-94 expired. The woman kept saying sorry to me & i told her i was very diappointed on how this system works. So i have gone one step further with this & gone to the congressman John Mica's office to has this sorted. After talking with one of his aid workers they inform me that it don't matter whether you're I-94 has expired or not you are intitled to receive your SSN if you done everything that was required of you. So now they are handling the situation for me & looking into why this has happened. I will let you know what the outcome will be..

We first met online 2004, but things started to get serious in Dec 2007. Made my first visit to the USA in march 2008 for 2 weeks. Then returned again in Aug 2008 for 3 months.. Then i came back to the UK for 5 months to return back to the USA April 2009 for another 3months.

After talking with one of his aid workers they inform me that it don't matter whether you're I-94 has expired or not you are intitled to receive your SSN if you done everything that was required of you.

Now they are the ones talking BS. If your status has expired or is within 14 days of expiring no number can be assigned or card issued. It doesn't matter that you applied before the status being within the 14 day window.

Hey i'm only saying what they told to me... If they want to look into it then they can & they will want answers for why the process was taking so long... No harm in doing that is there? Just so annoyed with the fact that i did everything within the timescale.. So really no excuse for them wanting to delay the process unless they are such lazy asses & really don't want to deal with all the paperwork that goes with it..... Just a shame that this happens alot...

Didn't say you were lying, just that the congressman's office doesn't know what they are talking about. No harm in them asking, but the answer is going to be the same. Pretty sure SSA office will put the blame on immigration.
