Timeline

simply write a letter to NVC informing them that the petitioner is now a US citizen.

As a proof send photocopies of His US Passport and Naturalization Certificate..

also mention ur case details.i.e. ur name n dob and petitioner's name and DOB..u will be then considered under Immediate Relative Category and ur Interview will be scheduled within a very short time...

Just it will depend upon the US Consulate's Work load.....otherwise u dont have to wait for ur case to be current ..it will be current automatically...

Hi , My category is F2A and my case completed on Oct,8 at NVC so my husband now get his citizenship so we want to upgrade our case ,could you please let me know if we send the copy of his passport considering that my case was completed how long i have to wait for interview date? :unsure:

You should call the NVC ... you maybe given the option to send the Copy of the Naturalization Certificate OR Copy of the biographic US passport page. Sending the two is not necessary. Interviews are scheduled based on the work-load of the consulate and so reviewing the consulate/embassy section may be helpful to you. Unable to determine that IF your interview was not already scheduled or had the case up-graded.

I am in a similar situation and would appreciate anyone who could provide some guidance. I-130 (under F2A) for my spouse likely to be approved in a month or so. Home Country is INDIA, Priority Dates are retrogressed under F2A category. My N-400 is in process and likely to have interview in May/June. If everything goes well, I'd expect I-130 to be approved way before my naturalization. On to my questions

  • Once I-130 is approved, will NVC assign a case number irrespective of the Priority Date being retrogressed for F2A ?
  • Will I be able file Choice of Agent form and pay the AOS and IV dues at this time and make progress with the NVC steps? Where does the waiting game for PD happen- at NVC or at the consulate? OR will NVC just sit on the approved I-130 w/o any updates until PD becomes current
  • How would I go about upgrading the I-130 to CR1 category once I get the citizenship? Would that happen at NVC or Consulate. Dept of State instruc tions suggest that NVC be informed of citizenship for upgrade, but experiences here suggest contacting Consulate.

  • They are likely to process the DS-230 to assign a contact for the case. It is highly unlikely you will pay the AOS & IV dues. The waiting game happens at the NVC stage while they sit on the approved case (I130). If your case was forwarded to the consulate and you had an interview and retrogression happens again then no visa will be issued.
  • How would I go about upgrading the I-130 to CR1 category once I get the citizenship? Would that happen at NVC or Consulate. Dept of State instruc tions suggest that NVC be informed of citizenship for upgrade, but experiences here suggest contacting Consulate.
  • The Update is done at the NVC stage. They would request a copy of the certificate or passport (proof of US Citizenship). They do advise to inform the consulate at the time of the interview IF THE CASE was already transferred to the consulate.

Quick clarification - Did you mean to say 'They are likely to process the I-130 DS-230 to assign a contact for the case.' From what I read from the forums, DS-230 is submitted only after AOS and IV dues are paid.

No I'm sorry. Not the DS-230 (IV) BUT the DS-3032 (Choice of Address and Agent)
