Hi everyone.

My father is holding L-1 visa(multi national manager category) and working in California since 04. He filed i-140 and i-485 together in June 2009. I-140 was approved in Sept 2009, but the AoS is still under review on the USCIS case status page. We are worried about the AoS because he is travelling out of the country a lot to do business. Is he not supposed to do that while the AoS is still pending? What is the chance that he will get an interview request from USCIS? His L-1 visa will expire in March 2011. What is his options if his L-1 expired but AoS is still pending? My family is all on AoS right now.

An L-1 is a dual intent visa. As such, leaving the US while the AOS is pending does not usually result in the AOS application being considered abandoned. People entering with visas that do not allow for dual intent generally must get advance parole before leaving while their AOS is pending or they would be abandoning their AOS application.

05/01/2013 - Removal of Conditions - APPROVED!
