Applying for tourist visa while K1 pending

My Elena got one, but that was before we applied for the K-1. She had the solid ties to Russia that were needed, including ownership of two apartments and a steady job with one company for several years. Also she had a long history of responsible international travel, mostly for business.

But I would not want her to apply for one now, with the K-1 pending. She would have to sign off on a statement that she does not intend to immigrate when USCIS already has a statement by her in connection with the K-1 that she does intend to immigrate. If they would compare notes on the two visa applications, I could see considerable trouble. It is not worth the risk.

We have had an I-130 petition for my step-daughter for a while and had her apply for a tourist visa. I wrote a letter to the embassy detailing her petition application and ensuring them we would not risk it by allowing her to overstay on the tourist visa. She was successful with getting the tourist visa.

If at first you don't succeed, then sky diving is not for you.

ok, so my fiance had his interview today and he was told without even giving him any chance to show ties to country and and looking at folder full of paperwork we have been working so hard on... Flat out, "you have to wait for K1 to complete, your intention is immigration and I cannot give you a tourist visa"

Oh well, not the end of the road at least.

Oh well, not the end of the road at least.

Sorry it didn't work out for you two on the visitors visa. They're not giving many of those out when you have a pending K1 in the works though. Anyway, it won't be long now just few more months till you hit the 5 month waiting goal of USCIS. After that, we hope it goes quickly.
