Timeline

Its been 2 years of marriage and now wife wants to go back home and get divorce, we now have a daughter and i do not want her to leave with her guess this is a multiple issue problem one if she wants to take daughter what right do I have two if its decided that my daughter is to stay here with me what am I going to be on the hook for as far as support for my wife. She has made life hell and I know there is no turning back now. I do not feel my daughter will have the oppurtunities in Colombia as she would here.

We cant advice you on this you need to seek a divorce lawyer. Your wife can do many things with divorce, it all depends on if she just wants to divorce or if she wants more from the divorce.

Very simple, really.

If your wife is determined to get a divorce, she'll get a divorce, whether you want her to or not. You may be able to delay it, but not to prevent it.

Your daughter, if she was born in the US, is a US citizen. Your wife, when moving back to Colombia, will not be able to take your daughter with her unless you explicitly authorize it. The US courts recognize a US citizen's right to remain in her country (which is the US), and if your wife would take your daughter with her (how would she get a US passport for her without your signature?), it would be child kidnapping. The US Embassy would press charges against your wife in Colombia and you can imagine how much pressure this would create.

Tell your wife that there's nothing you can do to prevent her from going back to Columbia, but that she won't be seeing her daughter again until she becomes an adult, as you wouldn't take the chance that she would be forced to remain in Colombia, plain and simple.

It may be possible for her to get a passport for her daughter. It may not be legal, but it can be done. Even if it is kidnapping, getting the child back would be expensive and could take a long time. I would recommend filing a form to put a watch for any passport applications for your daughter.

Reading thru the link, the concern would have to be her getting a Colombian passport (which would be legal).

"Q:What if my child has a passport of another country?a:Many United States citizen children who fall victim to international parental abduction possess dual nationality. While the Department of State will make every effort to avoid issuing a United States passport without the consent of both parents, the Department cannot prevent other countries from issuing their passports to children who are also their nationals. You can, however, ask a foreign embassy or consulate in the United States not to issue a passport to your child. Send the embassy or consulate a written request, along with certified complete copies of any court orders you have which address custody or the overseas travel of your child. In your letter, inform them that you are sending a copy of this request to the United States Department of State. This is so scary to me. It reminds me of the big story about David Goldman and his son Sean Goldman. His wife left him and took their 4 year old son to Brazil and he spent 5 years trying to get him back. David went through hell he wasn't even allowed to visit his soon until he got a US representative to speak in the Brazil courts. Please protect yourself and your daughter. There are several things you need to do to prepare for if and when your wife decides to take her away from you. (Sean goldman was a US citizen also)

I don't mean to sound dramatic but your daughter may be in danger of being abducted. I agree with everyone here please visit a lawyer for more advice and support to protect your rights.

Whatever you do...don't let your wife know about her being able to get a Colombian passport for your child,..maybe she doesnt know that she can actually do that. So unless she's well educated in this area,...dont entertain the thought saying in an argument with her "ahh and dont even think about taking a Colombian passport for our child"...that might be the end of everything.....be careful...stay stafe...i'll be praying for you,your wife and child

simple thought, i know it won't be simple as i wrote... try to get back things in order... talk to your wife. tell her that life is not about the selfish decisions of our own, the decision ll put a greater negative impact on your daughter. so talk with her first, try to solve the issue. nothing is impossible. there must be some reason why you got married... u know better.gud luck. hope you all smile once again.

I didn't read anything in the post saying to lie to her. Not telling her about an option to get a Columbian passport is not a lie. One thing I learned in my divorce, never give any information to your ex that you don't have to give. The less information she has, the better off you'll be. Don't open yourself up for her to make plans against you by letting her know what actions you're taking to stop her. Don't give her any ideas either.

The OP here never mentioned that his daughter was born in the US. If she was, then I don't think she can get a Columbian passport. This would mean that he only needs to put a watch on her getting a US passport by filling out the form that I mentioned. This won't stop her from getting a passport, but will allow you to be informed if she requests one. Once you are informed, then you can contest the passport. If she wasn't born in the US, I hope the previous suggestions for writing a letter will be enough to stop her from getting a Columbian passport.

It is also very important that the divorce degree states that the daughter cannot be moved more than a certain distance, 60 miles in my case, without notifying the other parent 60 days before. This gives you time to take her to court if she decides to move across the country. There should also be something in there stating she can't be taken out of the country without approval of both parents. If that is not there, the custodial parent may have the right to take the child out of the country without approval from the noncustodial parent.

Whether you call it a lie or not is a moral question. When you want to include praying, than at least be honest with yourself. I don't like the idea of somebody going after the poor woman. It's her daughter too and maybe she wants to leave her husband because he beats her up or cheats on her. I find it upsetting that only so few people seems to care about the mother. A divorce is what it is, a divorce. JJ61 put it right. You first try to talk and get it straight. When that doesn't work, you look what can be done, in a as human way as possible, following the law, like Bob said. I got a divorce too. I still call my ex and help her out where possible. This was hard work to establish but it worked out fine. Why should two people that fell in love at one time, hate each others guts so much that they want to destroy everything.
