Hello everyone

I have a specific question, I wonder if anyone would be able to answer it.

I work and go to school, my actual annual income won't qualify me, however I have savings and three types of stocks accounts.

I know I will be able to use my individual stocks account .However I am unsure if I am able to claim my stocks in my Roth IRA account ( money which is already taxed ) ?

I also have some money in a traditional IRA ( money that is not taxed, and there would be a penalty is I withdraw , however it is possible I would lose around 33% ).

Do you think I would be safe accounting for at least the Roth IRA balance ?

If I do not use the ROTH , I will be pass the poverty guidelines by $1,000 . ( Income + savings + individual stocks only )

Any opinions ? I am referring to part 7 , number 3 on I 864

I don't know much about stock, but I would think it would be considered assets, and NVC counts assets (not regular income) as 1/5, so you have to have value of assets equal or exceed five times the difference between your income and 125% poverty level. Like, if you need 40,000 and your income is 35,000, you assets should be valued at at least $25,000.

I believe savings are assets too, since this is not your regular income.

Maybe someone here will know more.

Hello everyone

I have a specific question, I wonder if anyone would be able to answer it.

I work and go to school, my actual annual income won't qualify me, however I have savings and three types of stocks accounts.

I know I will be able to use my individual stocks account .However I am unsure if I am able to claim my stocks in my Roth IRA account ( money which is already taxed ) ?

I also have some money in a traditional IRA ( money that is not taxed, and there would be a penalty is I withdraw , however it is possible I would lose around 33% ).

Do you think I would be safe accounting for at least the Roth IRA balance ?

If I do not use the ROTH , I will be pass the poverty guidelines by $1,000 . ( Income + savings + individual stocks only )

Any opinions ? I am referring to part 7 , number 3 on I 864

I think I would call the NVC and see what they have to say about it. I would think that stocks would count as an asset but they need to be proven as liquid assets - i.e. assets that can quickly be turned into cash. You may want to look into using a co-sponsor instead of taking a big financial hit from cashing out your IRA.

No, you are not required to prove health insurance, only your ability to provide for the new immigrant in general.

No, you don't wait for them to call you. They will never call you with your case number. It is your responsibility to call them. It is taking approx. 30 business days before they get you in the system with a case number from the time that they receive your file at the NVC.
