" ...... if the immigrant maybe bringing a spouse and/or children , or within 6 months of the immigrant's entry to the United States and you are sponsoring them, you should list the names and other requested information to the lines provide"

I think by this they mean derivatives. Like spouse and children of a son or daughter of a USC. Or derivative children on a K petition. Anyone who does not require a separate petition and comes as a derivative.

Well, Found out you the beneficiary has to go personally to request a copy of the police report. Thinking it wasn't that bad, I looked for the closest Austria embassy in Colombia.. and found out they closed it a few months ago. Now he either has to go to Ecuador, or try to find a Swiss embassy which is very far from where he is.

I hope I can get this done!

My Dad's I-130 Journey:

  • 02/15/2013 - Mailed I-130 to Chicago Lockbox
  • 02/25/2013 - Check cashed

  • 10/17/2013 - Case transferred to Nebraska Service Center
  • 11/13/2013 - NOA2 Received. We are approved!!

NVC

  • 11/13/2013 - File sent to NVC for processing
  • 12/23/2013 - Case entered
  • 01/09/2013 - DS-261 Choice of Agent sent
  • 01/13/2014 - Paid AOS fees
  • 01/15/2014 - Paid IV fees
  • 01/24/2014 - AOS and IV documents sent

I have not received anything from NVC so far, but that also means no RFE... so far:)

I guess I'll start calling them on March 3rd, if the case has not been completed by then.

"This is a tricky one but from what I understand you do NOT list the other parent on the I-864, as they have a separate I-864. This info was given to me by folks who just immigrated and are on this forum and their daughter initially put down both parents and got a checklist to correct it.. I am not listing my parents on the same I-864. Also be careful when calculating your household size. If you currently have a family of 4 for example, plus one parent, you would enter a total of 5, rather than calculating in each parent to make a family of 6. The reason being is because each parent gets a separate I-864."

My husband and I have just completed all the immigration process and are now in the USA. Our daughter, a USA Citizen petitioned for us on an IR-5 visa.

She was the only person to sponsor us so I can only comment on the way she completed the I-864. As we were on IR-5 visas, each of us had to apply separately, so our daughter had to complete 2 I-864's - one for me and one for my husband. She lives with her husband and 2 children and originally she completed them with a family size of 6 - 4 of them, 1 for the applicant and 1 for the other person she was sponsoring.

The NVC rejected these forms and she had to resubmit both of the forms with a family size of 5. (This delayed our visa by about 5 weeks).

If you are in any doubt about how to complete this section of the I-864 then I suggest you ring the NVC and ask them. I found them quite helpful.

As I say I can't comment on how you complete the form if there are joint sponsors, or on any other visa's than IR-5.

Good luck.

I am filling out AOS form for my parents. Now, I am getting mixed answers about particular questions. Since you are almost done, can you PLEASE help me with this.cray5ol.gif

  1. Household size in both the forms should be 5 ( myself, my husband, my son, my two immigrant parents) but then both the petitions are "two separate visa petitions", correct? and both are principal immigrants. So, what does NVC want as house hold size?
  2. Does this mean that both the petitions have nothing to do with each other?
  3. Do I still say that spouse will accompany (the form says that do not list ppl on other visa petition)helpsmilie.gif cray5ol.gif

Read Val's response above - she is done with the process and has immigrated. You do NOT count the other parent in your household size. Her daughter did this the first time and received a checklist for it. Each parent gets their own petition, so you only count the members of your own family and one parent on each form. In your case if it is you, husband, 2 sons and a parent, then you will list 4 on each AOS. You do not list the other parent.

It all has a knock-on effect unfortunately!

I am revising my answer for this - as of today, NVC is now telling people that they are extremely backlogged and not to expect a case number until 30 business days from the time that they receive the petition. Another effing back-log.

Thanks :)

But then the form tells to list ppl who are immigrating together, what do we do about that? cray5ol.gif

".

Good luck.

Thank you for posting your response helpsmilie.gif

Did your daughter mention you on your husband's form (and visa versa)? Technically, both are separate visa petitions so it means that they don't have anything to do with each other. But then again they are immigrating together ......oh the pain cray5ol.gif
