I have no income because I am a stay at home mom, only my husband works and his income meets the poverty guidelines. We file taxes jointly. I sent the Affidavit of Support I-864 today along with the supporting documents. As my husband only the joint sponsor, I just followed the instruction #9 in the I-864 Instructions:

"If the person who is seeking the immigration of one or more of his/her relatives cannot meet the income requirements, a "joint sponsor" who can meet the requirements may submit a Form I-864 to sponsor all or some of the family members. "

In Form I-864, I put my husband's name on item #1. (I am the sponsor submitting this affidavit of support because..) then I checked the box on item 1d. "I'm the only joint sponsor," I filled out the rest of the forms about the income information based on our 2012 IRS transcript.

So, I will have to let you guys know if I receive an RFE letter asking me to send Form I-864 and I-864A.

Your husband is NOT a joint sponsor. You had to fill out I-864 yourself and I-864a for your husband as household member.

Hi guys...I am confused. I was thinking that when my MIL's papers are approved and go to NVC, then they go to the embassy, she takes all her documents (birth certificate, passport, police certificate) with her to the interview. However, I have been reading some on here and it is seeming like maybe these documents need to be sent to NVC? My husband came on a K-3, so that is how his papers were done....but I am thinking maybe the way the IR works is different...I hope this makes sense.

You (or your MIL) have to mail all the supporting papers to NVC.

I also came on K-3 and took the documents to the interview with me.

This is not the case, however.

I had the same question a few days ago. According to my research and VJ family, we have to send all the original or certified civil documents, including police clearance, to NVC with IV package.

Oh, too bad for the person who told me that my husband could be a "joint sponsor." But thanks for the info, my package is still on transit so I still have the time to intercept its delivery. I just needed to fill out the form and give it to the post office and pay for it on Monday and send my proper documents at the same time .

I said your husband can be a joint sponsor because he can but he can also be used as a household member instead so it depends in what you want to do. I'm in the same position as you and I'm using my husband as a joint sponsor. Either way you still need the I-864 and I-864A.

Oh, I hope you didn't think that I'm talking about you, because it's not you. It was all my fault, I should had read more but now I know better, I exactly know what to do now with my dad's paper works, to avoid the mess . Thank you. Happy New Year!

Hopefully NVC figures it out and won't delay you with an RFE. Good luck.

Just found ouit today that due to the "government shutdown" we can't file the 2013 taxes before Jan. 28. That's lame. Probably will delay filing the AOS package for at least a month. I guess I can try and mail it as is with the old taxes and a fresh employment letter+paycheck stubs and hope for no RFE...

He could be a joint sponsor if the taxes were filed separately. As it is, the husband's income is the family's income and counts for the wife.

It can get pretty confusing though:) I've been doing immigration since 2004 and still have questions.

Thanks Okflyboy. So when filling out the I- 864A I wouldn't choose the Joint sponsor option since he's a household member, right?

Yeah, if you do not work and he is I-864a, you need his employment letter and his paycheck stubs.

Same for the joint sponsor if there is one.

No, your husband is not a joint sponsor. A joint sponsor would be someone outside of your household and your taxes.

I know what you mean. We have been waiting long enough... And I need my mom here as soon as possible so she can file for my brother. The longer my mom waits, the more time he loses without proper medical care and education. Special needs children are not loved in my native country. He was already forced out of kindergarten.

Oh no! That's must be hard for you and her, especially leaving him there for a while. I pray your process will speed up and he'll get to join you ASAP.
