Your husband is your household member. If you file jointly, you have joint income. You fill out I-864 and put your personal income as 0 if you don't have any, or whatever your income is if you have it, and the household income as whatever is on your joint tax return. Your husband fills out I-864a. But if you personally make enough to sponsor your parents, your husband doesn't have to participate.

If your joint income is enough, you do not need any other (joint) sponsors.

I have no income because I am a stay at home mom, only my husband works and his income meets the poverty guidelines. We file taxes jointly. I sent the Affidavit of Support I-864 today along with the supporting documents. As my husband only the joint sponsor, I just followed the instruction #9 in the I-864 Instructions:

"If the person who is seeking the immigration of one or more of his/her relatives cannot meet the income requirements, a "joint sponsor" who can meet the requirements may submit a Form I-864 to sponsor all or some of the family members. "

In Form I-864, I put my husband's name on item #1. (I am the sponsor submitting this affidavit of support because..) then I checked the box on item 1d. "I'm the only joint sponsor," I filled out the rest of the forms about the income information based on our 2012 IRS transcript.

So, I will have to let you guys know if I receive an RFE letter asking me to send Form I-864 and I-864A. :)

Just received a notice of case transfer to a local office for my MIL!!!! I was definitely not expecting it since so far seems like USCIS is looking at April petitions....

For I-864, you will submit all the supporting documents including other civil documents when you have paid the immigrant visa processing fees to NVC which normally happens a month after your I-130 gets approved and gets transferred to NVC. In your case I that will definitly happen in 2014 so for you I-864 you will have to submit the following:

Assuming you are the petitioner and only sponsor

- 2013 Tax Returns

- Letter of Employment from your employer

- Other Assets valued at about 25% than the desired amount on the poverty line for the house hold size incase your income does not meet their requirement for poverty requirement

These are the documents that I will use when I will submit for both my parents. In addition in my case I will also use I-864A, even though I dont have to but just to be on the safe side. My I-864A is going to be from wife's side. We both work have well over their requirement.

Offcourse this is just the i-864 Affidavit of Support documents. Then comes other civil documents which I still have to collect. I just hope my cases get approved quick so I can start thinking about the step 2 of this process.

I am telling you this because I still remember when i was going through my green card and at that time I was in college and had no income. At that time (about 5 years ago) I remember I got an RFE saying the same. So I had to re-do I-864 and then submit it again. But your case is moving quick so good luck.

Thank you. Even though I received my case # they're still not invoiced so I can't pay yet.

If you are working and you meet the poverty guideline then you do not need a joint sponsor. If you're unemployed or make less than the poverty guideline amount then you would need a joint sponsor (your husband or someone else).

So even if you file taxes jointly you don't need a co-sponsor unless you are unemployed or doesn't meet the poverty guideline.

OMG, I posted for the first time and I am so overwhelmed that I received so many replies. Thank you VJ family. Now the main challenge I have is make my parents get a certified copy of all the civil documents or just mail me all the originals and I can mail it to NVC.

That's why we're all here, to help each other from our experiences.

I had my mother and MIL send me original copies long ago so I don't need to wait when NVC asks for them.

Have your mother mail you them now. I also had her get all her vaccines and police certificate too. I have everything ready to send to NVC.

So once January 1st comes they will no longer accept 2013 tax return as the current one? Am I right?

Which means I will have to wait until after I get my tax return for 2013 to send them the most current paperwork. UGH!!!!!!!

Well, the latest taxes one can file is on February 3rd ( as far as I know). So if you send your paperwork in January, can you not send the additional tax papers later on? Also, as far as I know, the beneficiary can take the latest papers at the interview.

Hi guys...I am confused. I was thinking that when my MIL's papers are approved and go to NVC, then they go to the embassy, she takes all her documents (birth certificate, passport, police certificate) with her to the interview. However, I have been reading some on here and it is seeming like maybe these documents need to be sent to NVC? My husband came on a K-3, so that is how his papers were done....but I am thinking maybe the way the IR works is different...I hope this makes sense.

You can send them the I-864A now to them before the RFE so you won't get it . I think that can work, right?

I'm actually working on it, and tried to stop the mail delivery even :)... but just decided to let it go, and just send the proper docs on Monday. I assumed that they will not process my first package right away they receive it, so then after a day, hopefully the proper docs arrive. Maybe then, they can open the both mails together. :)
