J1 Waiver No Objection Italy timeline

Hello everyone,

I received my No Objection Letter from my Embassy two days ago. I am sure the Department of State has received the No objection Statement as well. That was the last document I needed to give them in order for them to start making a decision.

Now I am waiting for the Department of State to update this on their website. How long do you think it will take for the DOS to make a favorable recommendation? (My case: J-1 Waiver- No Objection).

I am still on a valid F-1 Status, but I would like to start applying for Adjustment of Status asap.

Can I send the AOS package with just the "favorable recommendation" ? Or do I need to wait for The Waiver? I would prefer not to wait that long...

Hello,

After I received the letter from my embassy it took about 10 days for DOS to update their website saying they received the letter and then another few days to say they sent the recommendation to USICS.

For your AOS you need to wait for the waiver. The favorable recommendation alone won't help you in this case..

I would personally wait for the waiver. Even if USCIS typically follows the DOS recommendation in case of No Objection, that letter is "officially" not your waiver and they would at least send you a RFE (I sincerely doubt that they will check your name in their files to see whether they granted your waiver). I have read a topic a while ago, stating that for uscis a FR is good enough, but I cannot find it (I will post it if I do).

Furthermore, they would wait for their own decision on the waiver to start processing your application anyway... Consider that if your AOS is based on marriage to a US citizen, your F1 overstay would be forgiven. I would prefer to send a pristine application, instead of a sloppy one missing something important such as the waiver. So, unless your are going out of status AND your AOS is not based on marriage, I would wait.

it says on the DOS website that the favorable recommendation was sent may 24th, however i haven't received it yet OR the letter from USCIS with my case number... any ideas what might have happened? What should I do?

Sorry, i'm confused!

You should just wait because there is a gap between the uscis decision and the uscis website update. However, if you really have want to try to talk to somebody, call USCIS and see whether they have more information, in case they just did not update the website. You are done with DOS for good so they wont have anything to tell you. See my timeline in the first post for more info.

You should just wait because there is a gap between the uscis decision and the uscis website update. It takes a while. If you d not have a case number yet, they cannot check either. So you just have to be patient... Sorry, I know waiting sucks! ;-)

Good news! I just checked my case status on the DOS website. They have received the NOS on June 7, 2011 and they have already issued a Favorable Recommendation! That was fast, I think.

I guess I just have to wait for the actual waiver. I will let you know. :)

Congratulations! Yep, now they will forward the Fav rec to USCIS, they will send you a case number and the waiver most likely will be accepted. Keep us posted!

Good news! I just checked my case status on the DOS website. They have received the NOS on June 7, 2011 and they have already issued a Favorable Recommendation! That was fast, I think.

I guess I just have to wait for the actual waiver. I will let you know. :)

yeah, keep us posted! cuz my favorable recommendation was sent on may 24th but i still haven't received any case number from USCIS! maybe u'll have more luck!

it's been almost 20 days I and still haven't received anything in the mail from DOS or from USCIS!!! no case number, no nothing.. I really don't know what's going on...
