Timeline

I just checked online and found that our I-130 application was also approved. The only problem is that I have no idea where this puts us in regards to finishing line. Can anyone tell me what significance this has?

Hey would love to help, as I am sure other would too but: :time:

In order to help more a time line and some information about your case is needed.

After the I-130 is approved there are 2 bills sent to you one for $70.00 and one for $380.00 that will generate your Immigratnt visa and your I-864 avidavit of support. The processing of these as you send the fees in and the NVC sends you the documents takes about 6-8 weeks to be completed.

Once NVC, National Visa center, has these completed they send your package to the embassy where your finacee lives, and you wait for an interview date. After the interview you get your visa.

Congratulations! NVC process will be around 3 months, if you are prompt submitting everything, then it will be upto the Embassy to schedule an interview, afther NVC will send the completed case to them. Please fill out your timeline which will enable readers to answer your questions better.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Woops sorry it seems like I've commited a faux pas! That's my timeline filled in now, thanks for all the info given. I've found that the people on the forum are extremely generous with the time they take to explain things; I really appreciate that.

Does having the I-130 approved make the I-129f obsolete?

vamos, are you a U.S. citizen living in Scotland? Are you a legal permanent resident there? Where is you wife from? What is her citizenship?

My wife is a U.S Citizen (from San Antonio, Texas) and has Further Leave to Remain in the U.K (2 years) which is based on our marriage. I myself am Scottish, a citizen of the United Kingdom. My wife could only become a permanent resident here (Indefinite Leave to Remain) if we were to stay and make an application after her two years are up.

In my humble, amateur opinion, do nothing for now.

Your I-130 was approved (hip hip hooray) and your I-129f is in the works. You can keep going with I-130, which may get an interview first. When that happens, you can drop the I-129f. But there's no point doing anything until you get an interview. You already paid your fees for each, so let them ride. And there's always the remote possibility that you get an I-129f interview first. Strange things happen.

I'm curious about your wife's U.S. domicile and whether she'll have income from a U.S. source. How are you handling these aspects?

So it's essentially a race between the two applications?

My wife's income is from a U.K source therefore her father has agreed to be a co-sponsor. We do have the problem of having to show proof that my wife plans to return to the U.S once the visa has been granted, this can be done by leasing an appartment or accepting a job offer to give two examples. We're quite worried about this aspect of things as obviously it would be an unnecessary financial burden to pay rent for a residence we're not staying at and to try to secure a job when we don't know when we'll be able to move back would be impossible.

Our 130 was approved about 2 weeks befor the 129 was also approved and I had the same concerns. Just from looking at timelins on this web site and speaking with the embassy here in Costa Rica. Our 129 interview wil be several months befor the 130 interview, but that is with this emabssy (Costa Rica as relatively short turn around times for processing visas and interiews, your consulate may be diff.)

I still don't understand what happens to the 130 processing. Whether the interview takes place in th U.S. or if we have to fly back here for the interview at the consulate. As for us, getting to us both back to the U.S. first is of primary concern so that I may start working again. Your situation may be different.

Yes, it's a race between petitions, but in your case it might be a tie because of the dates. The I-130 was approved Aug 8 and your I-129f is relatively new, with NOA1 on July 26.

You need to compare your timeline with others going through your Embassy (London?) to get a rough idea of when you might be called for either interview.

People who are certain K3 will gain entry quicker have the option to complete the greendcard process in the U.S. or have the foreign spouse go back to their country for the CR-1 interview. But for you, this would not be a quick, cheap trip. Nor, I'm assuming, would it make entry any quicker.

You could consider pursuing CR-1 because:

- the I-130 is approved

- the interview may come at the same time as a K3 interview

- you enter with a greencard ... no AOS pains or waiting to work

- it gives your wife time to prepare

Personally, I'd consider having your wife return to the States now to set up a residence and look for a job. Those things could be in place in time for your interview. It wouldn't be a long separation, but a constructive one.
