My wife came here (US) on a K1 fiancee visa. We were married August 2009. She got her permanent resident card April 2010. Her son now 19 years old followed later and arrived here August 2010. We filed his I-485 recently and received a "Request for Initial Evidence (I-485)". The box was checked and the following was stated on the form:

"Submit evidence that an immigrant visa petition has been filed on your behalf. Such evidence includes a copy of the I-797 Notice of Action on Form I-129F (Petition for Alien Fiancee), Form I-130 (Petition for Alien Relative), or Form I-360 (Petition for Amerasian, Widow(er), or Special Immigrant), and or a copy of Form I-171 (Notice of Approval from the Consular Office). If you are not filing as the beneficiary of an immigrant visa petition, submit documentation in support of your eligibility to become a Lawful Permanent Resident of the United States."

My question is what do I need to send them. Just the I-797 saying that my wife's I-129F was approved?

Thanks for any help. It seems they could make these things a little easier to understand.

They want a photo copy of your wife's I-129F approval notice attached to son's AOS. Son Followed to Join on a K-2 visa correct? You should have sent a photo copy of it to USCIS and kept the original when your wife adjusted status.

They are asking for a copy of this:

If you dont have the I-129F NOA2 letter, you can either:

File an I-824 for a replacement one Fee $405 Then wait for the replacement copy to attach to the I-485.

OR

If you married before son's 18th birthday file the I-485 with an I-130 and additional fee $420 and base the I-485 on a I-130 visa petition filed by a step parent.

Yes. just the proof off the K1 approval which we call NOA2. A photocopy is fine and as you filed your wife's based on the K1 approval, I assume you have a copy still that you sent with that.

If you do not have a copy, or you can't find it. Don't waste your time paying for a new one. There are more options than those posted above and a few threads talking about what else is accepted in place of a missing NOA2. Post again if you don't have it or can't find it and i'll try and locate threads that mention your options.
