Is there anything we can do now to prevent just in case out case get send back to USCIS?

Hi Everybody,

My fiancee is not interview yet and it still a little far from here. But, I am frustrated everyday as I see some reviews on this cite at HCM consulate where cases get sent back to USCIS for no reason and didn't even give any chance to provide evidences. I always keep my finger cross for a good news. But, I must be prepared for a worst scenarios. So I would like to know at this point is there anything we can do to prevent our case from being sent back to USCIS, like hiring an attorney or talk to a senator or something?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Most of what you could have done would need to have been done before you sent the petition. There are a lot of red flags that can cause a visa to be denied and a petition to be returned. Most of those red flags exist at the time the petition is filed, and they aren't adequately addressed in the petition. Attempts to fix those red flags after sending the petition are often not successful, but sometimes they give you a chance to address them at the interview.

Let's look at a few examples... :blush:

The number one reason for denying a visa at the consulate in HCMC is they believe the relationship is a sham. They cite a whole lot of reasons for coming to this conclusion. One common reason is that the petitioner has made only one or two trips to Vietnam. The petitioner could make ten more trips after filing the petition, and they could completely ignore it. It wouldn't change the fact that they are accusing the petitioner and beneficiary of jumping into a relationship with very little "face time" together. The best way to fix this red flag is to make more trips before filing the petition. Adequate time to develop the relationship makes a big difference to the CO.

Another reason they frequently cite is the petitioner and beneficiary didn't have a traditional engagement ceremony. Again, planning a Dam Hoi after you send the petition is often not sufficient to address this. Once again, in their eyes the petitioner jumped the gun and filed a petition before they were really engaged. The best way to fix this is to have the Dam Hoi before filing the petition, and don't do it on the first visit to Vietnam.

There are a number of other things that can cause a visa to be denied, but you get the idea. The best way to maximize your chances is to build a strong case before you send the petition. After you've sent the petition the only thing you can do is to determine what red flags still exist, prepare to address them at the interview, and hope the CO gives your fiancee a chance to do so.

I think I am lacking evidences to support that I was in Vietnam and lived temporary near the address where my fiancee worked at. I am in the process of asking a local Vietnamese authority overthere to sign and notorarize my letter (giay tam tru) to prove that I was there in 2009 for 2 weeks. I did have pictures of me and fiancee hang out with her co-workers in 2009. But, CO could say that may be fake evidences.

Here is my timeline and story with my fiance:

Explanation Letter of How My Fiancée and I Met

1. Description of detailed chronology of relationship between my fiancée, Cam Mong Thi Nguyen and me from November 2009 to present.

During my trip to Vietnam on November 22, 2009, I lived temporary at 54 Nguyen Tai Hoc, Phuong My Binh, Thanh Pho Long Xuyen. I met my fiancée for the first time at Coopmart Super Market in Long Xuyen city, where she worked as a saleslady. After a short conversation with her, I asked for her phone number. We started to be in touch by phone and going out for drinks and dinner, while I was in Vietnam. After I returned to U.S, we were talking through phone and internet connection using Skype. I returned to Vietnam on 3/24/2010, but I didn’t let her know about my trip. On March 31, 2010, I met my fiancée again at the guest house at An Giang University in area B. My fiancée worked at Coopmart Super Market which is a 5 minutes drive from there to that guest house. Luckily, she didn’t have to work that day and she didn’t go back to her hometown in Thot Not. From her hometown to Long Xuyen city is approximately a 30 minutes drive. Instead of driving that far to work every day, she decided to live with her aunt temporary. Her aunt is a good chef at An Giang University. During her free times or on her day off, she often helped her aunt prepare food for professors. This time we met, we were very excited and we talked a lot more than we used to. After a month and a half in Vietnam at Long Xuyen city, we have a lot of dates going on. I came to visit her at work and at her home. Her friends and families really like me. I started to fall in love with her, so I proposed to marry her on 5/13/2010 by 7:00 PM at Diamond café while we were dining. She accepted my proposal, but she felt a little shy. Since I didn’t expect to get marry in Vietnam, I didn’t prepare documents required by Vietnamese authority to get married in Vietnam. So we planned to get married in USA. For that reason, my fiancée and I officially celebrated our engagement party on 6/13/2010 conforming the Vietnamese traditional culture at my fiancée home, following a reception at Thang Loi 1 restaurant located at 1 Le Hong Phong, Phuong My Binh, Thanh Pho Long Xuyen city with approximately 320 guests. Although my sisters and brothers were not able to attend our engagement party, we turned on Skype with webcam and a large screen projector to allow them to virtually attend our engagement party. We plan to celebrate our wedding party in United States so my sisters and brothers can witness that I finally get married.

2. Family members attended and represented my fiancée and I in our engagement party included:

• My eldest sister and my brother in law (Nguyen Thi Hong Hoa and Nguyen Van Phuong)

• My sister in law, her mom, her dad and her uncle (Tran Thi Thuy Diem, Nguyen Thi Bay, Tran Van Son, Nguyen Van Kieu)

Honestly, there's really no telling how those monkeys will treat your case. Nobody knows. Just do the best you can. Make sure she interviews well (don't get nervous and screw up a question or more).

My best advice is not to expect too much and don't react too much to the results. Be strong! It's 50/50, but more like 25/75 on getting a pink.

Sont worry about the little things, what is done is done. If you are already affraid that you will be denied, then you will pass this feeling to your loved one, which will lead to more stress, and possibly a bad interview. Quit looking at all our cases and assuming that yours will be denied. Each case is different, and every CO is different. To answer your question, NO if they deny your visa there is basically nothing you can do to keep it at HCMC, unless...... you happen to be able to get through to the visa section cheif and he/she actually listens to your plea and then looks at your petition and feels that it warrants a further review. Once it is denied, it almost always goes back.

My mom passed away when I was eleven and my dad passed away 5 years ago. My relationship between my brothers and sisters are not that closed. I only have 1 eldest sister in Vietnam who attend my engagement ceremony. I hope HCM consulate will understand my situation.

He knew her longer and had seen her live more than I had and also None of my family came to my Engagement party and somehow they gave me a pink after an initial blue. He has done more than I did at the stage he is at now. What is the problem is the proof such as pictures and no pictures of the engagement party.

The best thing is to gather as much evidence as possible of the relationship such as emails and chats and so on. Do a much better timeline. Start from here on out doing all possible showing an ongoing relationship. There is more of course but you really need to strengthen up the relationship proof.

BTW, I do have pictures of engagement party and pictures showing my sisters and brothers on a large projector on Skype that day. I just lack of the evidences to show that I lived near the workplace where my fiancee worked in 2009.

Also, what do you mean by do a much better timeline? Should I reword my timeline a little? Please advise.

I returned to Vietnam on 3/24/2010, but I didn’t let her know about my trip. On March 31, 2010, I met my fiancée again at the guest house at An Giang University in area B. My fiancée worked at Coopmart Super Market which is a 5 minutes drive from there to that guest house. Luckily, she didn’t have to work that day and she didn’t go back to her hometown in Thot Not. From her hometown to Long Xuyen city is approximately a 30 minutes drive. Instead of driving that far to work every day, she decided to live with her aunt temporary. Her aunt is a good chef at An Giang University. During her free times or on her day off, she often helped her aunt prepare food for professors. This time we met, we were very excited and we talked a lot more than we used to. After a month and a half in Vietnam at Long Xuyen city, we have a lot of dates going on. I came to visit her at work and at her home. Her friends and families really like me. I started to fall in love with her, so I proposed to marry her on 5/13/2010 by 7:00 PM at Diamond café while we were dining. She accepted my proposal, but she felt a little shy. Since I didn’t expect to get marry in Vietnam, I didn’t prepare documents required by Vietnamese authority to get married in Vietnam. So we planned to get married in USA. For that reason, my fiancée and I officially celebrated our engagement party on 6/13/2010 conforming the Vietnamese traditional culture at my fiancée home, following a reception at Thang Loi 1 restaurant located at 1 Le Hong Phong, Phuong My Binh, Thanh Pho Long Xuyen city with approximately 320 guests. Although my sisters and brothers were not able to attend our engagement party, we turned on Skype with webcam and a large screen projector to allow them to virtually attend our engagement party. We plan to celebrate our wedding party in United States so my sisters and brothers can witness that I finally get married.

2. Family members attended and represented my fiancée and I in our engagement party included:

• My eldest sister and my brother in law (Nguyen Thi Hong Hoa and Nguyen Van Phuong)

• My sister in law, her mom, her dad and her uncle (Tran Thi Thuy Diem, Nguyen Thi Bay, Tran Van Son, Nguyen Van Kieu)

• My fiancée mom and dad (Nguyen Thi Luyen and Nguyen Hung Anh)

• My fiancée’s brother and sister and her cousins

After a short conversation with her, I asked for her phone number. We started to be in touch by phone and going out for drinks and dinner, while I was in Vietnam. After I returned to U.S, we were talking through phone and internet connection using Skype.
