Hi,

Does anyone know if you are able to travel outside the US (for a honeymoon) & return back again; whilst you're K1 visa is being processed?

As looking at the visa itself, The "no. entries" field states 1. Which I assume counts as the arrival in the US.

I have trawled through the forums with no apparent suggestions being forthcoming.

Honeymoon BEFORE marriage?? As long as you do not enter the USA on the K-1, and do not marry before entry on the K-1 then you are fine. Also if you marry before entry to the USA on K-1, you will be starting over and filing an I-130 for a spouse visa.

K-1 is for entry then marriage, if you do this how can you honeymoon outside the USA AFTER marriage??

If you enter the USA and marry on K-1, you need to file I-485, and I-131 for AOS and AP, and should not leave the USA until you have either Green-card or AP document in hand.. If you do you will be starting over with filing an I-130 for a spouse visa.

This is my understand of it. If your fiance comes to the United States on a K-1 visa then he can only enter one time on that visa. When you get married he is still on that visa until he gets his green card. So I would stay in the United States until he gets his green card. Our honeymoon will be in the states. It will be a minimoon and then maybe in a year we will take a bigger trip.

The USC can travel outside the US and return whenever they'd like. The foreign fiance, however, can't leave the United States until they've filed for Advanced Parole, which happens after you get married.

This is not correct. Not only must the foreign fiancee "file for" Advanced Parole but they must actually receive it. It takes three months. Actually nothing prevents the foreigner from leaving the USA. The issue is getting back in.

Facts are cheap...knowing how to use them is precious...

Well, yes. Filing and receiving it is what I meant. I assumed the receiving part was implied. My mistake.

It's not. Some benefits only need to be filed for and others received before they are of any value. When helping people here, it's better to be accurate than to depend on others to properly comprehend what you imply.

Let's take both: While the K-1 is being processed, by definition the beneficiary did not yet enter the U.S. and can therefore travel to whatever country will admit the beneficiary with whatever passport/travel visa he/she may have.

But if we are talking post U.S. entry with the K-1, we all know that it is a huge no-no without first obtaining advance parole. And this has been a huge trap for many who are not aware. Passport control will be more than happy to let you out without any warning, but when you try to get back in, SURPRISE!

To clarify your first point, you cannot be married and enter on a K1, so if the OP intends to have a "true" honeymoon (in that it occurs after the wedding/marriage ceremony), the K1 visa will no longer be applicable. A spousal visa will be needed, which means restarting the process.

OP when you say honeymoon this implies you will already married. The K-1 visa is for individuals who are 'engaged' to be married (hence fiance visa). If you are already married BEFORE you get your K-1 visa the process and procedures are different, and as stated you'd have to start all over again. This I hope you realize before it's to late.

From the looks of things perhaps a bit more research is in order?

Now if you simply mean "Can I travel after my K-1 is processed and approved" then that would be different. But from how I'm reading it, it sounds like you intend to marry BEFORE your K-1 visa is processed. Please understand just because you are in the stages of getting your K-1 visa this doesn't mean you have it yet. Just filing does not mean you can get married and be considered a K-1 visa holder.

Please re think things a bit.

Sorry bro, your question is a bit un-clear to give you a good answer. But from what you wrote, all I can say,

-No "honeymoon" allowed before the visa is issued. You cannot marry at this stage>

-As for regular trips/travel outside the US, then you and her (or you and him) are as free as a bird.

Hello All,

Just to clarify my initial question which may have was hastily posted.

I was asking of the about travelling on a honeymoon outside of US borders after entry on the K1 and after marriage on US soil. I now this would not be advisable without acquiring AP and filing for an AOS.

We are going around the travel restrictions by having two smaller honeymoons. One before marriage and the other after marriage. The former will be in the cold snowy Hokkaido area of Japan, the latter in warm tropical Hawaii in the summer. :lol:
