221 g EVIDENCE OF CURRENT INCOME

Hi everyone i am new here in visa journey.Hope some one could help.First of all I would like to ask what is really the required income for a household of 4?I was interviewed but then I was given a refusal letter and need to submit evidence of current sustained income. My fiance's previous income were very low he couldnt work full time due to his heart bypass surgery but this year he is able to do so.We already submitted everything that we think as proof of sustained income.He is a self-employed contractor.We submitted an employment letter, check from his tenant, no checks or pay stubs coz he is paid on cash but its stated on his employment letter and his ITR for 2010 we were not able to send it because filing it still on mid January that we think could delay the process. These would be enough? We did not wait for the ITR for 2010 because we want to make an earlier results coz my medical will expire on the 29th of January we don't want to do the medical again because of that sputum and culture exam and waited for 2 months thank God it was negative.I submitted those through a courier as instructed by the USEM how many days is the waiting period?Please help.We are so near yet so far.Hope next year is a good year for us. I want to be with my fiance as soon as possible.

Hi chenglai i think we have the same struggle..i want to share to you what is being shared to me by good hearted vj members, they said what we need are contract letters or any contract agreement between your fiance and the client,bank statements and bank letter if your fiance has bank savings,check stubs from clients,self employment letter,for me il just wait for 2010 ITR because my medical will expire in march 8.i will give you the link of poverty guideline,i hope this will help you..please share to me the outcome when you submit it all.we are almost in the same situation.here is the poverty gi-864p.pdfuideline

i recieved that also evidence current sustained income.. my fiance incresed october so i submit paystubs en employement letter and also he's above poverty starting november 1.. my fiance and i so only 2 household.. i wish we all approved.. HAPPY NEW YEAR..

So they also returned your passport to you? I guess we are in the same situation it is just during my interview i have gave them the proofs of income and they did not require any more proofs. We can give them another evidences tho like letter from the bank, life insurance, and proof of his properties. But they never asked for it, they told us to just wait for the result of review.

Yes i also filled up the 2GO form. We do follow up our case every week but sad coz theres still no feedback.

When was your interview? and is your fiance's income tax return last year also below poverty line?

For a household of 4, @ 100% of the federal poverty guideline, the income requirement is $22,050, and @125% its $27,563.

Given that mid January is only a couple of weeks away, I would think of filing the income tax return earlier if at all possible. Given that your fiancee is self employed with a cash based income source, it can be difficult to demonstrate income definitively, but submitting a recently filed income tax return accepted by the IRS may just give you that "evidence of current" income you need.

A self employed contractor would not have an "employment letter". He might have a contract. Typically, the self employed are required to use a complete tax return as evidence of "income". The qualifying income is from line 22 of the 1040 form. I would wait until you have that tax return in hand, as they are likely to deny the visa if you push for a decision without it.

I may also get caught in that same situation. I am self employed and business annually shows very little profit and sometines a loss. I had my accountant write a letter saying I have assets near $300,000 and no mortgages or liens I hope this will be enough. Any opinions please share. It will just be her and I no other dependents

You'll need to document the value of the assets as instructed in the I-864 instructions. (Better instructions than I-134) An accountant's statement is not good enough without actual documentation. The assets must be able to be reasonably liquidated within a year without undue harm to the sponsor or sponsor's family.

Did you include a letter from employer that states your current income level and length of time in the job ?

yes we submitted an employment letter that states his current and previous income, that they are wishing to continue his service of the company,check from his tenant and explanation letter from him about his past income and the reason why we are not able to submit it the 2011 ITR yet.Many people says that it is more likely to be denied but still we have big hopes and crossing our fingers very tightly for us to be approve.hope the one who will review the case would be more considerate and will have a good heart.

i only asked to pass income tax return last year, letter of employment, and his pay stubs, and yes i submitted it. My fiance is currently employed to a company. He got his new job last March of this year.
