I'm a bit confused and really worried right now because my husband is here on a K1 and has been here since January. His alien card doesn't expire until 2012. I just saw his social security card today and it says it expires in 2 months! This would mean he would lose his job and right now he is the only one of us who is working. He works all the same hours that the SS office is open so he can't call yet and they won't talk to me.

I know that there is one other step we have to do (and I'm totally blanking on it right now) but I didn't think we had to do that until 6 months prior to his resident alien card expiring.

Why would they make his social expire before his resident alien card? Do I need to worry? I also need to figure out what the last step is that we have to do and triple check the date I need to do it.

There is no expiration date on a Social Security Card. He should've gone back to SSA office when he got his green card so they can remove restriction on his SS card.

For employment purposes, GC plus a SS card OR Driver's license and a SS card (unrestricted) is sufficient proof.

Please go back and let us know exactly what is expiring soon.

Also, 90 days before your husband's 2-yr GC expiration, you MUST send in the form I-751 with evidence to remove conditions on his green card. You can read more on this in the Removal of Conditions section of this forum.

Your husband's K-1 visa was a single entry visa. It expired the moment he was "admitted" to the US.

From thereon, his legal presence was documented by the I-94 card in his passport.

The moment your petition to adjust status was approved, the I-94 became worthless and the I-551, nicknamed Green Card, took over the function of the I-94.

The social security card itself does not provide authorization to work.

Some cards, I have have one of them (issued back in early 1991), say "not valid for employment."

Others say: "only valid for employment with DHS authorization."

Then there are cards who don't have anything on them.

None of this matters. First of all, it's not very common to even have to show the card (hence I still have my original one); most of the time just the SSN has to be submitted. Secondly, the Green Card is the DHS authorization to work. So if your husband shows his Green Card, nothing else matters. SS cards don't expire and SSNs never change. It's a non-issue.

I would say you are also confused on the visa type. You say he is here on a K1, but your profile and the timeline in your signature indicate it is a CR1 visa. AND you've posted in a K3 forum.

I agree with Bob that if he has a greencard, that's all he needs to continue working. But I am curious why you think the SS card is expiring. I've never heard of that being written on the card. Where do you see the expiration written?

Because it says right on the SS Card that it expires 2/21/2011. His employer has also told him that when it does expire he needs to bring in an updated one or he can't work. Also his CA drivers license is set to expire on the same date b/c of the SS card and the DMV just sent us paperwork saying we need to send proof that his stay has been extended and they will issue him a new drivers license.

Also his CA drivers license is set to expire on the same date b/c of the SS card and the DMV just sent us paperwork saying we need to send proof that his stay has been extended and they will issue him a new drivers license.

Easy solution - have husband go in to SSA office with his green card and get it updated - this will get him an unrestricted SS card - normal ones do NOT have any expiration date.

Go to DMV with his green card and get the new DL.

The DMV should accept his green card as proof his stay has been accepted, so that should take care of the driver's license problem. Your husband also should check with his employer--see if his green card will be sufficient for evidence. If you look on the back, under the big green "Permanent Resident Card" there is a line saying "The person identified on this card is authorized to work and reside in the U.S." I imagine that will be enough. If not, go with him to the SS office as soon as possible and bring his green card. That should be enough evidence for them to issue him a new "permanent" Social Security card that he can take to his employer.

Don't know what you are looking at, but it sure isn't an SSN card if it has an expiration date printed on it. Cards that have been issued since April 2007 have the date they were issued on them. That is the only date you will find on an SSN card.
