Form I-864

Hello everybody!!!

I came over USA under a K1 visa and now we are about to go for the AOS.

My husband got recently laid off from his job and now he's unemployed. He did the affidavit of support for my K1 visa and now we need a joint sponsor.

His brother is going to do it but do we need to put in the AOS two I-864 forms? One from my husband (since he's the main sponsor) and another from his brother (the joint sponsor)? Or just his brother's?

You should file an I-864 for both the primary and the joint sponsor. Read pages 2 and 3 of the I-864 Instructions for the detailed filing requirements. http://www.uscis.gov.../i-864instr.pdf

Here are some quotes from the instructions:

"The petitioning sponsor must sign and complete Form I-864, even if a joint sponsor also submits an I-864 to meet the income requirement."

"If the person who is seeking the immigration of one or more of his or her relatives cannot meet the income requirements, a "joint sponsor" who can meet the requirements may submit a Form I-864 to sponsor all or some of the family members."
