My husband and I are applying for DCF in Bucharest, Romania. I finished school this year and have never made enough money to file for taxes. I do have a job waiting for me in which I will be making over the 125% poverty limit. Is that enough to be the sole sponsor for i-864? I do not have anyone that would be able to co-sponsor.

Also, in the i-864 and i-864ez instructions (on the actual form)it states "If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it." Does anyone have an example of such a letter or know how to write one? How do I prove that I was exempt? (I do have W2 forms that show that I made less than the amount necessary in order to file, and I am also listed as a dependent on my parent's tax returns..is that what I need to use to show that I was exempt?)

i believe you need an income or sponsor . i advice call a lawyer many answer questions for free on the phone

Depending on how long you have been in the job and how much over the limits you make will be a deciding factor. If you are way over the limit ( like 3 times) you may get by on a job you have gotten out of school. However most people don't have that kind of first job and would probably be asked to have a co sponsor to show stability of income. It is best to be well prepared. Talk to the likely candidates such as your parents about co sponsoring and see if you have a willing co sponsor. If so ask if you can have the papers from them at the interview "just in case" It is so disappointing to people to get through the interview only to be hung up with searching for a co sponsor

This will not be over quickly. You will not enjoy this.

The promise of employment is not generally enough. But you can leave the country as soon as the I-130 is filed, so you could file it via DCF, then move to the USA, start work, and have a few paystubs ready by the time the interview comes around.

For the tax exemption letter, keep it short- here is what my husband wrote:

To Whom It May Concern:

I am Mr Penguin, Penguin's husband and petitioning sponsor. I did not file an income tax return for the years 2005, 2006 or 2007 because I have not worked during my 3 year residence within the Republic of Ireland. Once I came to Ireland, I was unable to find work and so used savings; I was maintained by my wife upon her income and savings. Since I made no income for these years of any type, I was not required to file an income tax return with the Internal Revenue Service.

Sincerely, Mr Penguin.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, that is what we are planning to do. The same week we will be filing i-130 via DCF, I will be leaving for the US in order to begin my job. So I will be able to send him at least one paystub along with the i-864 for the interview.

I am leaving for the US right after we submit I-130 at the consulate and I will begin working right away. So we should be good then right?
