Status Online Says "RFE sent Dec. 22" but we haven't even done biometrics!

Hi all,

My hubby and I filed in November to adjust status but still haven't received a biometrics letter (as far as we know, since we went out of town and haven't checked our mailbox in two weeks and won't be able to until 2011)

Our USCIS account was finally updated for the I-485 and it says an RFE was sent on Dec. 22.

Could the RFE refer to the biometrics letter? I find it strange that it would be an actual RFE, since we haven't done the biometrics yet.

But I've also heard that rfe's can be sent anytime in the , whether or not you've done a biometrics so if any of you have stories/anecdotes/advice that'd be great.

It sucks not being able to know the contents of the RFE letter since we're snowed in and can't go home until next week.

you should try calling the customer service number 1-800-375-5283,it's always busy keep dailing until you get a live person,give all you information,and ask whats the RFE about, and you are still waiting for your appointment letter for biometrics,,i hope you can get a answer, good luck on that.

I did. She said she didn't know the contents of the letter and to call back after 15 days.

Has anyone ever gotten an RFE before a biometrics letter/apointment?

I got an RFE first before my biometrics letter which took 5 months to arrive, today I got my EAD card. I applied in June. It's really hard to say when exactly the biometrics will arrive, sometimes it depends if there's a back log of applicants in your state it will take awhile.

By the way, the RFE is nothing you can't do. In my case, they asked for a copy of our marriage certificate even if I enclosed a copy of it in one of the forms and the Federal Income Tax for 2009.

It's completely normal to get an RFE before biometrics.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

Yes it's possible to get an RFE any time during the process...kittyfang, a November filer, received her RFE before her biometrics I believe.

08/2009 Sibling petition approved but ineligible to adjust status due to overstay

11/22/10 [day 0]- mailed AOS packet!! should be there by noon 11/23/2010

12/3/10 [day 11]- received email/text notification of acceptance from USCIS

12/3/10 hubby surprised me with a trip to Los Angeles for my birthday...no problems :)

12/6/10 [day 14]- received hard copy NOA1 in mail

12/7/10 [day 15]- checks cashed...ouch

12/15/10 [day 23]- rec'd biometrics appt set for Dec. 28th at 10 am! :)

12/28/10 [day 36]- successful biometrics appt

01/27/11 [day 66]- rec'd interview appt set for March 10th at 10 am :)

02/25/11 [day 95]- rec'd EAD

03/10/11 [day 109]- Interview, Green card approved!! :)

Next Step: Removing conditions in 2 years.

RFE's can come at any time, including at the interview. Biometrics has nothing to do with it. I assume they found something missing from your paperwork.

Thanks for the responses.

So since I've received the RFE before biometrics, does that automatically imply that the biometrics appointment letter will be delayed/won't be sent out on a regular time line? As in, if this is an actual RFE, will they freeze the biometrics process/not bother setting up an appointment until I respond to the RFE?

I've heard of people on this forum getting both an RFE notice/Biometrics notice at around or exactly the same time and that they seem to be independent events.

We got an RFE before biometrics. We hadn't sent enough pictures (needed extra for the AP). It had nothing to do with biometrics. If the website said it's an RFE then it probably is - totally separate from biometrics.

I would be very interested in knowing how many passport style photos you sent with the original package. I sent only two photos with each of three AOS packages, and the AP was approved without any RFE's.
