Had my medical exam in Manila last Jan. 4 & 5. Husband has been unemployed since Dec. 2009, had my interview last March without his letter of employment and pay stubs. USEM only checked his tax return, and we wrote on the I-134 that he's still employed, in short, we lied. Came here, we got married. Had my ds 3025 trancribed and now, we are pretty sure he's going back to work probably 1st or 2nd week of January because his coworker called him yesterday, however, no call yet from the company. I don't want to spend some money for another medical exam here, so I want to mail the paperwork soon. Our question is, does the USCIS need to receive our papers before Jan. 4th or after Jan. 4th?

Your replies will be very much appreciated. Thank you.

They definitely would have to receive AND PROCESS the paperwork before January 4, which means sending the paperwork in NOW, like...today. I would imagine your NOA1 would have to be dated before January 4. Even if you send it in today that seems unlikely, especially considering Friday is a federal holiday and there's a weekend in there as well.

You'll likely have to get another medical. You can try sending it in now and wait for the likely RFE or just do a new medical now and include it with your AOS.
