Waiting Civil Surgeon - Close to Visa Expiration

Timeline

We did get married in time, but now waiting on the Civil Surgeon before sending in the AOS package. (Waiting to see whether to get the Rubella shot or not)

We are really close to the visa expiration...Is there someone we should contact in the government or just send in the package as soon as we can after getting the CS to finish things up?

March 18, 2010 - I-129F Mailed

March 24, 2010 - Check cashed

March 27, 2010 - Got NOA1 in mail Dated 3/22/2010

June 17, 2010 - NOA2

July 16, 2010 - Arrives at GUZ

July 26, 2010 - Packet 3 Arrives

July 28, 2010 Packet Mailed

Aug 5, 2010 DOS says Packet 3 received

August 23, 2010 Interview Scheduled Sept 27

August 28, 2010 Received Packet 4

September 27, 2010 Interview/Approved

November 5, 2010 Married

Timeline

The VISA is expired it expired the day she entered the USA.

You have to go by the I-94 in her passport not the visa.

You married in time so you have nothing to worry about anyways. Just get the civil surgeon papers and then mail the AOS right away.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Sorry, the visa expired the day she was processed at Immigration at a POE -

OTOH -

she was issued an I-94 - and

you two were married prior to the 90 day expiration on the I-94 -

so

she's good !!!

Is not any 'window' for when to file for AOS, ever.

USCIS says 'asap!'

but - is no federal rule/law about it.

Be relaxed, go easy, and when yer ready -- DO IT !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
