I am reapplying for my hubbys AOS.I am the USC.we got married in may 2008 and had our initial interview in april 2009,which we failed woefully due to my hubby's over-confidence and lack of prep.He moved in with me after we got married in 2008 but at the time he was in college in the east coast while we live down south.Hes always home on school breaks but later finish college in dec 2009.He wasnt on my lease at the time.I told him about this but he was like,thats not a biggie,as long as we love each,we shldnt go crazy about it and i kept quiet bout it.so by the time of our interview,in April,we havent much evidence together of co-mingling of asset.Anyway on the day of the interview,we got in and was sworn in by the officer.Ok,the good part first,he asked us for our id,which we gave to him,and ask the basic yes or no question which we answered.he later asked my hubby,my dob,place of birth,date of marriage,name and date of birth of my son which he answered everything right.now to me,he ask me our address,his d.o.b,when we got married,which i got everything.he later asked for his mothers name which i cldnt pronounce, but I remember that when i talked to his mom once he told me to address his mom by her baptism name,which wasnt on d form.

Now to the bad part,he asked my husband what documentation we have together and my husband,just gave him our joint bank acct,joint at&t phone bill,and a utility bill showing only my husband name on it.At that point,he was pissed because of my hubbys nonchalant attitude.the thing is my hubby is such a sweet guy but he has this carefree attitude.This prompts the IO to seperate us.He asks us about 16 questions which we answered 10 correctly and flunk the rest.Am not gonna duel on the ones we got correct.He asks for my hubbys roommate in college in which i said A but my husband said B, unknown to me,i usually talk to A,but my hubby was given a new roomy B(A was caught smoking weed,so was booted out-my hubby went to a Jesuit college).Also i was asked what present we had exchange on xmas,and my hubby said none.(i had opened the present he bought for me on, xmas EVE ,even though he told me not to,and he got pissed when he got home that night.(present was meant to surprise me).So we technically opened the gift on xmas eve and not on xmas day,So he answered none for xmas and i answered yes.Also he asked where my husband was on a specific hurricane day,and i told him he was in school prepping for exams which my husband confirmed,but when he ask my Hubby where i was,he said i was at home in new orleans(my mom had just visited which he knew,but i took the little opportunity to quickly go with my mom for 3 days to ATL,to fix her new place.i wasnt even thinking of telling him thinking it was really not a big deal since my hubby was writing is exam at the time),So i answered i was in ATL.Later the IO ask color of me n hubby's toothbrush which i got and my hubby doesnt even know his own toothbrush color.So he answered wrongly.i cant remember the last question but i know we answered wrongly.

Then the interviewer called us both and said we didnt do good in our interview,so my hubby asked him that,he should try and still approve us since,he was in school around the time of our marriage.But the IO said he would send a reply to us in the mail,after that my hubby went back to school to finish up with his exams and he graduated in dec 2009.

The IO did send an intent to deny letter and ask to provide more documentation as to why he shouldnt deny us.But my hubby said 30 days was too short and he ignored it and wish to refile at a later date.A month later,he sent a denial letter.

Now my hubby is done with school,and my lease @ the old apt was up since may 2010.Now we have moved into a new 3 bedroom apt with both our names in the lease,he's got a new job,we got joint bank account,joint utility bill,cable and internet in both our names,LIFE insurance and i named as a beneficiary on it,joint health insurance,a letter from my mom and sister notarized attesting to our marriage and joint life,xmas cards and present addressed to both of us...etc

Now we have refiled a new AOS, nov 22rd and within a month,hes done is BIOMETRIC-dec 23rd,now we waiting on the interview(that was pretty fast).We dont want to make mistakes we did in our first attempt.Hes been looking at little details around the house he had taken for granted before-lol, his toothbrush color.

This is the first marriage for both of us,he his 27 and am 33.Now my question is how do you think we can prepare better for this next interview,and how adversely can the first interview impact on the new one.Would we have a STOKE interview(Do we need to answer new questions 100% correctly),and would they based their determination on the old one,also my hubby has told me that i they decides to go personal and ask the sex position kind of questions,he would decline,politely, no matter what they think.

My last concern is that,during the past year,my hubby has received 2 great job offers from is home country in Africa,and he really thought of going for it but each time,i talked him out of it,maybe am wrong,i am thinking he doesnt wanna fully pursue the AOS.He has even bought 2 tickets for a trip for both of us,to go to is home country in the summer.So pls i would appreciate any insight as to how to fully prepare for this second interview.

What is your husbands current status in the US ? Did he enter on a student visa? If he entered on a K1 and AOS is denied, is there a deportation order for him based on the fact the first AOS was denied ? More information is needed before much of an answer can be given. AOS isn't something you keep submitting until you get a positive answer. Usually if your are denied you have to leave the country

This will not be over quickly. You will not enjoy this.

He entered as an F-1,but still,maintained status as he was in college when he got denied..But he's out of college now and has a new EAD card based on the new AOS,he is not under any deportation order,because his name wasnt found on uscis hotline.Hes on OPT now.

Ok , You will most likely have a more difficult time the second time around as they have already listed your marriage as suspect. You should probably have front loaded the petition by sending n more than required to demonstrate the validity of your marriage. Make sure to have a nice folder of your evidence. When Joseph and I had ours I think the IO saw that whenever he asked for something in the folder ( Joseph had it) I knew where it was also. How you behave towards each other is as important as knowing the tooth brush color. Married people have a way of interacting that fake couples don't develop.

He probably misses home, but you as a couple should make a decision if you want to live there. Living in West Africa is very different than living here and is something you might not adapt to or you may love it.

This will not be over quickly. You will not enjoy this.

If I were you I would prepare by having as much evidence as possible with you when and if you have an interview. Good luck welcome to VJ and if your husband does take the job back in Ghana you should definitely consider going with him I love GHANA it is a beautiful place!!! and there are tons of Americans there. My fiance and I will definitely move back to Nigeria when the time comes I love that place!!!!

Wow, your husband exactly sounds like mine. He's a petioner though. He's so confident about the interview coming up . He doesnt care about evidence because he said his love for me is enough but he doesn't really understand immigration stuff is cruel and based on evidence. Tell me how your interview goes this time so I can tell him to be all prepared and stop being confident :)

@patient 2010:yea i would love to move with him,but just that i want him to get his papers first,and how dont really know what to expect from over there in africa,am from the carribean and the few times i talked with them,they were real awesome.I hope we passed this 2nd times as this both our first marriage,and its been a yr and half since we filed the last one,but our love still stands.
