Hi All.

I have been married to a military guy for more than 3 years now and after so long finally the IR-1 Visa has been approved. My husband decided to divorce me just few weeks ago, and i am still in my country i havent left to go to the US yet. I am planning to go to the US using my IR visa but i plan on staying on my relatives in the US, that way when he files the divorce i am in the US already.

What could be the possible consequence, if i get in the US and stay with my relatives on a different state for a week or month then i am going back to my home country. i will put the address of the Green card at my relatives house when delivered, will that be a problem in the POE? Also do we get checked by the Immigration or the police if i am actually in my husbands place.

Please help me. i just wnat to clarify this, i am having 2nd thoughts.

If your husband notifies USCIS that he wished to revoke his petition or Affidavit of Support you could be refused entry as the IR-1 Visa will no longer be valid.

Technically using an IR-1 Visa to enter the US when you know the marriage is ending can be seen as Immigration Fraud since the Visa was issued to unite your family but now your use of it would be for other purposes.

Once you've used the Visa and been issued a Green card there is nothing he can do to revoke that Green card though.

You should be having second thoughts. Why are you still planning on using the visa to come to the US if you and your husband are getting divorced?
