Hello everyone, we came to us in 1995 under the resident alien status,my oldest brother left his girlfriend behind,to make the long story short he left u.s. 2 months short from getting his green card in the mail. He has been living there in belarus since then, now he has a family but would like to come back to live you u.s. he still has social security number. I am willing to do whatever it takes to bring them here to u.s. with us. Please give. Me some ideas that I can start looking at. Thanks to everyone.

You don't tell us how you were able to get resident status in the first place. If it was through your parents, and your parents are still in the US and US citizens now, they can petition for him as an immediate relative (their child). If so, that goes pretty quickly.

If it's only you who is a relative of your brother, then you must be a US citizen. if you got your Green Card in 1995, that is likely the case. If so, you can petition for your brother, but it will take a very long time.

If you are not a US citizen, you cannot petition for your brother at all. Green Card holders can only petition for a spouse (husband/wife).

from what is says his brother is married with kids. it says that he has a family.

even if his parents would file for him, married children over 21, takes a very long time, over 8 years. It doesn't look like his brother is unmarried and under 21 which would have made him an immediate relative.

My parents are not usc but they will if it will help getting my brother over here. Thanks guy for ur responses, i've even tried contacting lawyers on ny but not having any luck with them calling me back.

how old is he and is he single or married?

that makes a big difference on how long does he have to wait.

He is 33, and yes he has a family of 3 kids, all of them were born in belarus

even if your parents became USC, it takes more than 9 years for them to petition a married child, they are working with January 1st, 2001 the category 3 for married children of a USC.

if you are a USC, you can file for him ss well. the 4th category for siblings is on January 1st, 2002, so anyways more than 8 years.

if any of you decide to file for him, he will still have the A# that he had and the SS number. those are his forever.

His past asylum claim and family connections will go against him, his family connections outside the US may balance it out.
