First, they don't intend on keeping you apart. They have a job to do, which is to determine whether he qualifies for the visa. One part of that job is to make a fairly subjective decision about whether he is likely to become a public charge, if they let him come here. They take their job seriously and many US taxpayers thank them for doing so.

Your option now is to find a joint sponsor and have them complete an I-864 and provide the needed supporting documentation, so you husband can get those papers to to the Immigrant Visa Unit and get his visa. Otherwise, you wait until you file a tax return with qualifying income. You'll have an opportunity to do that about 40 days from now.

Well said, Push. There is NO emotion involved with the USCIS when processing our cases. We are all just numbers and money to them. The sooner we accept this the better, and play the game, jump thru hoops according to their rules.

Surviving the process is a daily struggle, but somehow we all get thru it. Don't give up.

I am sorry for all head and heart ache with you situation. Could you get a second job to help you qualify as the sponser?

Sorry to hear you are going through so many issues, but like many have said here, regroup. Yes these people take their jobs seriously, some are vindictive hatefuly individuals working in an unorganized manner, and some are courteous concientious professionals you have both sides of the coin like anywhere, but in your case it sounds like they are workng with you. You dont have any relatives who could help you out?

Income used for the affidavit must be income that will continue when the couple is in the US. If the non USC is working online and will continue to do so then their income may be considered.

This will not be over quickly. You will not enjoy this.
