I need help with the document that I should send with the I-130 for my brother and his wife and couple children,I'm US citizen.

Accourding to the instructions I only need to send my birth certificate,his birth certificate, I-130,$420 and prove of citizenship.

Do I need to send his marriage certificate his wife and children birth certificate????

Since you're only required to send photocopies with the I-130 to the USCIS I would suggest sending copies of the documents that you mentioned just to preclude possible receipt of an RFE. I looked over the instructions that pertain to your situation just as you did and and didn't see them mentioned either. It appears that the immigration of you brother's wife and children is implied by you petitioning him on the I-130. Just remember that you will be submitting a DS-230 (applying for a visa) for each of them once you get to the NVC stage of the process.

Once you submit the items the long wait begins. The current wait for a visa number is nine years. Your brothers family may change in composition during that time. If his child is a teenage he may be too old to come with him by the time a visa number is available.

This will not be over quickly. You will not enjoy this.

Thanks guys I will send everything to be sure. I know its a long time but His kids are only 3 and 5 years old, I think they should be covered as long as they are below 21 at the day of the interview. I'm acctualy doing this for them so they can go to college in the US.

hasn't the processing time for brother/sister changed upto 4 yrs or something.??? the currant case being processed are 2006 according to the timeline..

IR-1 / CR-1 Visa

2010-04-19: approved online wohoooo

2010-04-24: NOA2 hardcopy received

2010-04-26: gave 2 email addresses and assigned case #

2010-04-27: received/sent ds3032, AOS bill

2010-05-01: IV bill became available online/paid

2010-05-06: sent in DS230 package via express mail 9:07am

2010-05-11: NVC acknowledges the receipt of AOS on 05/05

2010-05-13: operator told me that AOS sent to supervisor for review....

2010-05-14: AVR changes to received the checklist letter response on 5/13

2010-05-23: RFE for original birth cert. (i did sent original).......arghhh

2010-05-24: BC under review by some department

2010-06-02: sent in original BC again and previous BC is still under review

2010-06-10: NVC recognizes BC into their system

2010-06-15: BC under review

2010-06-21: SIF!!!!!omggggg soo happy 57 days in NVC process

2010-06-28: interview on Aug. 19, 8am.

2010-08-19: interview went fine but he's put into AP :(

2011-01-09: almost 5 months in AP "still pending"

2011-02-06: 5 and half months and still counting......when is this torture going to end....

2011-02-20: 6 months still no answer..........

2011-03-08: more than 200 days passed in AP..................(

2011-03-24: visa has been issued today. hurayyyyyyyyyy finally wait is overrrr.

but if u look at the current processing times, it says USCIS is processing cases of 2006?? so it's like 4 yrs

Again, the only authority of relevance to sibling petition is the NVC bulletin - right here>>http://travel.state.gov/visa/bulletin/bulletin_5212.html

Clearly says it's processing cases from 01 JAN 02 so that's almost a 9 year wait.

You can certainly dig around the USCIS processing dates, but they're not relevant if the visa number is not available for a long time... USCIS approves petition in 4 yrs or so YAY, THEN you get to wait some more...

i want to sponsor for my brother too, but I'm not sure if I only file form I-130 alone for each of him and his wife?

or should I file I-485 for each of them as well?

You have to file just file I-130 only for your brother along with his Birth certificate(Photocopy) Only..
