Hi All,

my reentry permit is going to expire in the next weeks. As a pity I need still some time abroad so I will not manage to come AND stay in the U.S. in the next months.

Idea is to apply for second Reentry Permit to be on the safe side. Question is, do I need to do the Biometrics again? I already have done that the first time two years ago....

Thank You,

G

Yes you would need to do biometrics again because you are sending a new application TWO YEARS LATER. Thats the key, they need to update your files from that long ago.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thank you Inky!

Even I hoped that Biometrics is not needed again...

Now I have another problem and it's really getting nasty. since of the bad weather, i was Not able to get on the flight today. Situation stays bad at the East Coast. Question now is: i have an old reentry permit expires 2jan. the last time i entered us was 2aug. will i loose my GC when i try to enter US end of Jan ?

I will try to get on a flight tommorrow again, but chances are low ;(

Please help & comment!

I counldn't say, its really up to the CBP as to if they take your LPR card away or not =(

Explain the issues with the weather and the flights etc, just hope.

Thank You,

Yes it is really a bad feeling that is always a challenge at the poe.

I will try to get to chicago tomorrow. Hopefully it works. So you would say an expired reentry permit does not mean that they take my gc away?

actually it shouldn't since i visited us several times during "my period of absence" and there is still this 6 month rule.

However I would be on the safe side, when I a´can fly tomorrow..

Thank You,

G

My response is a bit late. ACTUALLY EXTREMELY LATE. Hopefully this helps those in similar situations in the future.

The re entry permit has an expiration date printed. You are allowed to stay outside the U.S. up to the date printed on your re entry permit. NOT TWO YEARS FROM YOUR MOST RECENT DEPARTURE FROM THE UNITED STATES. Hence, if yours expired yesterday but you having left the U.S. just two days ago will not buy two more years.

If you applied for a re entry permit and left the country before it is approved, chances are the expiration date will be two years from the date of the approval date. This approval date can be 3-6 months from the time of departure. So it is possible to be outside the U.S. for over two years on a single two year re entry permit.

**** filed K3/CR1 concurrently. My wife and I both work/live overseas. The following timeline continues from the approval of the K3 VISA.
